체육시설 민간위탁에 대한 법적 한계 분석

본 연구는 민간위탁이 되고 있는 공공서비스 중에서 체육시설의 민간 위탁 실태와 법적 한계를 분석하여 그 대안을 제시하고자한 것이다. 본 연구에서 제시한 주요 내용은 다음과 같다. 첫째, 지방자치단체에서 민간위탁을 둘러싸고 제기되는 문제와 한계점들 중 큰 부분이 위탁이라는 제도에서 비롯되므로 효과적인 민간위탁을 광범위하게 실현하기 위해서는 위탁제도를 법적인 측면에서 개선할 것을 제안했다. 둘째, 지방자치단체 차원에서 보다 합리적이고 효과적인 민간위탁을 실시하기 위해서는 민간위탁을 둘러싼 제도와 관리방식 등이 체계화되어야 하므로 민간위탁의 목적, 민간위탁에 대한 개념, 민간위탁의 대상기능, 민간위탁대상에서의 배제기능 등이 조례에 구체적으로 제시되어야 한다는 점을 제시하였다. 끝으로 체육시설의 활용도 제고에 대한 정책추진은 단순히 시설관리정책의 차원을 넘어서 국민에 대한 체육복지서비스의 제공과 지방자치단체의 재정부담완화, 그리고 체육시설 등을 통한 국가 스포츠산업 발전정책과 연계성을 갖추면서 이루어져 한다는 점을 지적하였다.
Abstract
This study is intended to analyze the status of sports facility consignment and its legal limitations among public services which are consigned to the private sector and to present the alternatives. The main suggestions of the study are followed. Firstly, because the big part among the problems and limitations which are arisen from the private consignment of local government, originate with the system called as the consignment, the study suggests to improve the consignment system in the legal aspect in order to actualize an effective consignment widely. Secondly, the system and the management method of consignment must be systemized to conduct the reasonable and effective consignment in the position of local government. Accordingly, this study suggests that a purpose of consignment, definition of consignment, and consignment's function, and an exclusive function of consignment target must be prescribed in the law. Finally, the study points out that the policy for the improvement of sports facility utilization must provide the sports welfare service to people, release the local government's financial burden and have the connection with the national sports industry development policy through the sports facility, not just the facility management policy.
