조선총독부가 가족법규에 관습법을 채택한 것에는 정치적 의미가 내재되어 있었다. 그것은 다름 아닌 관습의 특성을 식민지 통치에 이용한다는 것이었다. 관습은 시대에 따라 변화하고, 불명확하다는 특성이 있다. 따라서 관습법은 법적 안정성과 통일성을 결여하기 쉬운 제도였다. 그럼에도 불구하고 관습법의 이러한 단점은 식민지 정치에서 장점으로 활용되었다. 첫째, 조선 관습이 존재하지 않는다거나 불명확하다는 것을 이유로 일본 민법의 내용을 판례에 도입할 수 있었다. 둘째, 법원의 창설 판결을 통해 사실상 입법행위를 할 수 있다. 셋째, 일본 민법상의 가족법규를 완급을 조절해가며 순차적으로 이식시킬 수 있었다. 결국 관습법은 조선의 특이한 관습이 성문화되어 고착화되는 것을 예방하면서, 일본의 가족제도를 자연스럽게 조선에 이식시키는 시간을 벌어준다는 이점이 있었다. 장점(유연성)과 단점(불명확성)을 동시에 내포하고 있다는 바로 그 점 때문에 관습법은 적극적으로 채택되었다. 조선총독부의 입장에서 관습법의 이러한 장단점은 조선의 가족 관습을 변화시킬 수 있는 ‘자유재량권’을 의미했다. 만일 일본 內地의 민법을 처음부터 그대로 적용할 경우 조선인의 저항이라는 부작용을 감수해야만 했던 반면, 관습법을 채택할 경우에는 이중의 효과를 기대할 수 있었다. 한편에서는 마치 조선의 관습을 존중하는 듯한 모습을 보임으로써 조선인의 심리적 반발을 무마할 수 있었으며, 다른 한편에서는 관습의 변화를 이유로 일본의 민법을 적용시킬 수 있었다. 이렇게 보면, 관습법은 일종의 ‘靜中動’의 정책이었다.
Abstract
This paper was studied on the purpose of customary Law that Imperial Japan adopted on domestic Relations and Inheritance. there was political intention by Japanese Colonialism. The adoption of the principle of customary law prevent the Korean traditional family practices from converting their enacted law. And the colonial court establish a precedent by which Japanese family law is disguised as traditional family custom. In short, customary law was a strategy that was introduced to invent customs under Japanese Civil Law and simultaneously to soften a shock that would be occurred under direct application of Japanese Civil Law. Ultimately Imperial Japan demand strongly to unify family law, particularly the laws of domestic relations and inheritance under a code of Japanese civil law. Should such the thing come to be realized, the way to mix the Korean blood and the Japanese blood will be opened. In other words, a racial mixture between Korean people and Japanese people is ultimately to result from the unification of family law of both. A racial mixture repeats, moreover, itself again and again, as time goes by. The unification of family law of both peoples means that it was to accomplish the reproduction system by which Korean is assimilated and converted to Japanese.
