어업권 소멸로 인한 손실보상금의 분배에 관한 사례조사연구

1976년 경북 월성군의 원자력 발전소가 건설되면서 주변해역의 1종 공동어업권에 대해 어업피해조사가 처음으로 실시된 이래 최근까지 약 600여건의 어업보상관련 조사 사업이 수행되었다. 또한 현재까지 어업손실보상금으로 지급된 금액은 경상가격으로 약 1조원 이상되는 것으로 추정되고 있으며 어업보상관련 조사 및 용역사업의 경비만도 수백억원에 이를 것으로 추산되고 있다. 그런데 이처럼 막대한 규모의 보상금이 지급되어온 그간의 어업피해조사와 관련하여 사업시행자(정부, 지방자치단체, 민간기업 등), 피해어민, 용역수행기관(학계, 연구소 및 감정평가사 등)의 최근 주된 관심은 어업손실평가의 표준화에 맞추어져 있었다. 그러나 엄청난 액수의 보상금을 수령하게 된 어업현장은 보상금분배를 놓고 상호 불신과 갈등이 도를 지나서 소송이 잇따르는 등 어민공동체의 내부분열이 지속되어 왔다. 특히 어촌계가 취득한 어업권에 대한 손실보상금의 분배를 놓고는 어촌계마다 홍역을 치르고 있고 소송이 그치지 않고 있는 실정이다. 본 논문에서는 이상과 같은 보상금분배를 둘러싼 어촌 공동체의 현안, 특히 어촌계 공동소유의 어업권의 손실보상금 분배에 대한 사례를 조사분석하고 그 합리적인 해결책을 제시 한다.
Abstract
As a nuclear power plant at Weolsung in Gyeongsanbuk-do is constructed, about 600 cases of fishery compensation investigation has been performed since fishery damage inquiry. Up until now more than one million won was estimated to be payed as fishery damage compensation. Cost of projects relevant to fishery compensation was estimated as several tens billion. The standardization for fishery damage evaluation became a major concern among project ordering organizations, fishers damaged, and project performing organizations. However, fisher communities have been splitted due to lawsuits for compensation distribution after receiving enormous amount distribution money. In particular, the distribution of compensation for loss relevant to fishery right obtained by fisher associations has had bitter experiences and been filed as lawsuits. This paper considers current problems of fisher association for distribution of compensation of loss, investigates case studies on distribution of compensation of loss for fisher right in fisher communities, and suggests resonable solutions.
