통일후 토지소유권제도에 관한 연구

초록
서독은 統一以後 體制統合에의 費用을 감당 할 能力이 相對的으로 南韓보다는 優秀하였고, 그럼에도 불구하고 統一費用으로 인해 적지 않은 어려움을 겪고 있다. 통일 이후 不在地主들의 所有權 분쟁에 소요된 보상에 대한 豫算이 막대하였다는 점에서 우리의 對策마련이 時急함을 알 수 있으며, 하나의 土地를 두고 所有權에 대한 분쟁이 일어나게 되면 公益의 目的으로 政府가 개입하게 되고 이때의 政府介入은 正當한 分配와 衡平을 맞추기 위한 助言者의 役割이어야 한다. 이에 特別法(가칭 토지등의통일에관한법률)의 制定을 주장하는 바이며, 所有權을 주장하고자 하는 자가 직접 本人의 所有權을 立證해야 하는 立證責任의 歸屬 問題를 分明히 해 놓아 시류에 便乘하여 무조건 주장 해 보자는 식의 消耗性 紛爭을 줄이는 實益이 있다. 北韓地域所在 土地에 대한 所有權 주장에 대하여 현 占有者와의 마찰을 피하기 위해서는 所有權에 대한 國家的 次元의 보상만이 解決策 일 것이다. 設問에서도 알 수 있는 바와 같이 각 시점의 公示地價의 差額만큼을 보상하고, 現金補償이 原則이겠으나 그 面積의 多少에 따라 土地相換 債券 등으로 지불을 猶豫할 수 있을 것이다. 補償金등의 財源을 確保하기 위해 稅收(가칭 統一稅)의 確保가 있어야 할 것이며 이미 南韓의 不動産關聯 分野에서는 綜合不動産稅라는 稅目으로 土地稅의 2원화를 도모하고 있으니, 이로 인해 마련된 稅源의 일부는 통일을 위한 特別會計로서 관리되어야 할 것이다.
Abstract
Though Germany is even wealthier and powerful than South Korea, they have still faced with the number of difficulties because of the expense of unification. In the post-unification, as the compensation to absentee landlords of Germany is much bigger than expected. We should work out the measure of compensation to absentee landlords urgently, and If there a dispute with ownership of a piece of land, the government should intervene in the dispute just as a arbitrator to share fairly and be open and be unbiased.Therefore, the special law as for the ownership of the land in post-unification has to be legislated to be practical. So if someone insists on the ownership of land in the North Korea after the unification, the burden of proof have to be involved in the claim. As the result of questionnaire, the differences of the assessed value of land at each point of time should be compensated and the compensation should be paid cash but with issuing land exchanging bond, it could be postponed as the extent of land. The yield of tax (tentatively named "The unification tax") should be secured. The integrated realestate tax system has already been imposed in South Korea. With the tax, the national tax revenue is partially collected from the land. Government should reserve some of the revenue for post-unification.
