초록
개인 정보의 보호 및 관리와 관련된 문제는 윤리적 행위의 당사자로서 개인과 직접적으로 연관된 것이라는 점에서 윤리적 논의의 대상으로의 의미를 지닌다. 개인정보의 침해를 사전에 예방하고, 사후에 지체없이 구제하고자 하는 사회적 노력은 정보주체로서 개인의 존엄과 자유로운 인격의 형성 및 발전을 위한 시도로서 윤리적 의미를 지닌다. 개인정보 보호의 윤리적 근거는 먼저, 이해 당사자들의 권리와 정당한 이해관계를 존중해 주는 세심한 배려를 통해 인터넷 관련 기술을 배포하고 또한 사이버 공간에 통용되는 규칙과 정책들을 개발해야 할 도덕적 의무에서 찾을 수 있다. 다음으로, 개인정보는 사회경제적 측면에서 공리주의적인 계산의 대상이 되는 것이 아니라 정의와 공정성의 기초가 되는 구성요소로서 결코 보류되거나 폐지될 수 없는 기본적인 인간의 권리라는 측면에서 이해될 수 있다. 마지막으로, 개인의 실존을 구성하는 구성요소로서 개인정보가 기능하고 있다면, 그러한 개인정보의 침해를 통하여 달성하고자 하는 어떠한 계획이나 목표는 개인정보를 침해당하는 개인의 가치를 결코 능가할 수 없다는 설명이 가능하다. 인간의 존재를 구성하는 하나의 요소로서 개인정보의 중요성은 현존재로의 인간의 실존적 의미를 사이버 공간으로 확장할 수 있도록 하는 것이며, 또한 이에 대한 보호는 인간 존엄성에 대한 재확인으로 연결될 수 있을 것이다.
Abstract
Security and management of private information is one of the most important subject in the ethical debate that it is directly connected with each individual as an ethical agent. It is the trial of uplifting human dignity and humanity that making every social endeavor to prevent infringement and relief works for guaranteeing private information. The ethical basis of security and management of private information is as follows : First, moral obligation of developing rules and policies which go everywhere in the cyberspace by paying prudent regard to the justifiable interest of multi stakeholders. Second, private information as a basic human rights which could not be hold back or discarded for it prepares the grounds of justice and fairness. Third, the individual human being itself is the most valuable than any other plan or goal which violates his or her private information, for it contains human existence. It could expand the meaning of human existence as "dasein" to the cyberspace that the importance of private information as an essential element of human being. Guardianship of private information could also be linked to the reaffirmation of human dignities.
