초록
이 글은 고용보험제도가 노동시장의 변화에 맞추어 적극적으로 변화에 부응하고 있는지에 대한 회의(懷疑)에서 출발 한다. 고용보험제도가 “실업급여”의 성격이 짙은 사회보험제도에서 “적극적 노동시장정책”의 또 다른 고유기능을 충실히 이행하고 있는지에 대한 문제제기이다. 문제제기에 대한 검토 결과부터 밝히면, 고용보험제도가 노동시장의 변화에 적극적으로 대응하지 못하고 있다고 본다. 보건복지부가 노인인구 증가에 따라 요양비(요양보험)를 담당하는 별도의 보험 제도를 도입하겠다는 정책결정과 좋은 대조를 이룬다 하겠다. 바꾸어 말해 고용보험제도는 노동시장 변화의 화두인 비정규직 근로자 문제에 능동적이지 못한 자세를 보이고 있다는 것이다. “사회보장제도는 노동시장의 문제와 긴밀히 연계되면서 상호 보완하는 방향으로 개선되어야 한다고” 보는 입장과 배치된다고 하겠다. 따라서 이 글은 비정규직 근로자 문제 해결에 일조하기 위해서 “적극적 노동시장정책”의 보완 제시를 연구의 목적으로 설정하였다. 구체적으로 고용보험제도는 적극적 노동시장정책에서 사실상의 실효성을 담보하는 “보다 적극적 노동시장정책”으로 정책적 전환을 주문하고 있다. 보다 중요한 개선 점은 기존의 고용보험제도의 성격(이) = 소극적 노동시장정책(즉 실업급여) > 적극적 노동시장정책(즉 고용안정+직업능력개발)에서 고용보험제도의 성격(이) = 소극적 노동시장정책(즉 실업급여) < 적극적 노동시장정책(즉 고용안정+직업능력개발) 로 그 비중이 옮겨가거나 균형을 맞춰가는 데 있다고 보고 있다.
Abstract
The purpose of this study is to analyse the matter of a actual significant issue in labor market, d. h. nonstandard workforce and suggest to modify a existing Korean Employment Insurance. Why? Because Korean Employment Insurance can not respond properly this kinds of change in labor market. The issue of nonstandard workforce seems to become a critical social risk in an another sense. So it has to need to reform Korean Employment Insurance, which is closely related to states's labor market policy. KEL should be revised from "active labor market policy" to "more active labor market policy". A modified KEL could lead into a level of a developed welfare state. So it means a historical turning point in social insurance policy. A historical turning point intends that a issue of nonstandard workforce can be solved only not by a logic of Insurance or economic market but by a social consensus.
