정보화사회에서 학교교육목적상 저작권 제한: 저작권법 제23조와 미국 저작권을 중심으로

초록
정보통신기술의 발달에 따라 사회의 변화 뿐아니라 학교교육에도 상당한 영향을 미치고 있다. 즉, 다양한 매체를 통한 수업이 가능해지고, 사이버학교가 설립되었으며, 교과용도서의 양태가 변화하고 있다. 특히 정보통신기술을 활용함에 따라 학교교육의 교수-학습에 있어 다양한 매체를 활용하여 다양한 자료를 통한 교육이 가능해 짐에 따라 교수-학습방법의 개선과 교육의 질향상에 상당한 효과를 줄 것으로 파악된다. 한편 다양한 교육자료를 활용할 수 있게 됨에 따라 타인의 저작물 사용이 증가함에 따라 현행 저작권법의 변화가 요청된다. 이를 위해 최근의 미국저작권법의 변화와 판례를 살펴봄으로써 학교교육과 관련된 우리나라 저작권법 제23조를 재조명해보고, 저작권법 개정의 필요성과 방향을 제시해 보고자 하였다. 결국, 본고는 정보화사회에서 저작권자의 권리를 보호하면서 또한 교사의 교육권을 보장하는 방안을 모색해보고자 했으며, 이를 통해 학생의 다양한 교육을 받을 권리, 즉 학습권을 보장하는데 주요 목적이 있다.
Abstract
ICT(Information & Communication Technology) have an effect on both the Society and the School Education in Information Era. Namely, it is able to instruct with various media, e-Book and others. Also, it is able to educate the cyber space and cyber class. It is assume that ICT have an effect on the quality of Education and teaching method It appears new works and this change needs more works for instruction. In America, New laws make preparation for this change. It is Digital millenium copyright Act and The Technical, Education and copyright Hamonization Act. This act include the transmission right and the display right as the right of works and this right limits for the fair use. Korea copyright act prescribe the fair use for Education, too. But this act does not include the transmission right and the display right. Expecially, Display right is only for the art works. This right is very important to teach with various media and various works in Information Era. So, I think that Transmission right and Display right is included in Copyright act articles 23. If this right is included in copyright act, it is good for teacher's right and student's rights. Only when included, it is considerd the right of works.
