학교자치론에 기초한 교사회, 학부모회 법제 개편 방안 연구

The purpose of this study is to explore the reform scheme of legislative system relating with school autonomy like that the organizations of the teachers, parents, students, and school governing body. This thesis examined the laws and regulations relating with the primary and secondary schools like that "Act of Education Basis", "Act of Primary and Secondary Education" and so on. Also, this study examined the theories of school autonomy, the legal status of primary and secondary schools, and school governing related rights of teachers, parents, and students. This study results are as follows. First, the reform direction of legislative system for school autonomy should be correspond to the aims for pubic education system or school education. And it should be secure that the autonomous organizations of teachers, parents, students and school governing body on the basis of diversity and characteristics of public or private schools. Second, principals, school governing body, and "the council of school affairs" composed of teachers practice the centered roles for the school autonomy. Third, "Act of Primary and Secondary Education" empowers "the council school affairs" to deliberate matters related with the curriculum, instruction, and school affairs etc. Fourth, "Act of Primary and Secondary Education" empowers the organization of parents to deliberate or propose matters related with the school governance. Fifth, Students practice the autonomous rights related to promote student prosperity. Sixth, "Act of Primary and Secondary Education" empowers "the school governing body" to advise, deliberate, resolve matters in accordance with the different provisions per the kind of school affairs.
