미국의 투자협정 모델 개정과 시사점

한국과 미국은 자유무역협정 체결을 위한 협상 개시에 합의하였다. 이에 따라 양국은 자유무역협정 협상 차원에서 투자 부문 협상을 진행하게 될 것이다. 이는 중단된 양자간투자협정 협상이 사실상 재개되는 것으로 이해될 수도 있다. 그러나 기본적으로 자유무역협정의 한 부분으로서의 협상이라는 점에서 양자간투자협정 협상과는 성격이 다르다고 할 수 있다. 또한 내용적인 측면에서도 양자간투자협정 협상이 미국의 1994년 투자협정 모델을 기초로 한데 반해 자유무역협정 협상 차원에서의 투자 부문 협상은 2004년 개정 모델에 기초하여 이루어질 것이라는 점에서 차이가 있다. 본 논문은 1994년 투자협정 모델과 비교하여 2004년 개정모델이 담고 있는 내용상의 주요 특징 중에서, 특히 미국과의 투자 부문 협상과정에서 우리가 주목해야 할 세 가지 측면에 대해 고찰하고 있다. 첫 번째 측면은 투자자 대 정부간 분쟁과 관련하여, 투자자의 제소 사유중의 하나로 빈번히 거론되고 있는 간접적 수용 규정의 2004년 개정 모델에서의 특징을 살펴보고 있다. 두 번째 측면은 환경 및 노동 측면에서 강화된 내용으로, 특히 투자와 노동 문제에 있어 기준약화금지 규정의 도입과 그 의미에 대해 살펴보고 있다. 세 번째 측면은 양자간투자협정 협상 과정에서 쟁점 이슈였던 세이프가드 규정의 존치 문제와 스크린쿼터 문제와 관련된 내용 부분을 살펴보고, 자유무역협정 협상에서 이들 이슈에 대한 논의의 전개 방향을 전망하고 있다.
Abstract
Korea and the U.S. agreed to start negotiations on Free Trade Agreement. The FTA could be concluded around the next March after a year or so of negotiations. Accordingly, the Korea-U.S. Bilateral Investment Treaty talks, deadlocked for years, will resume through negotiations within the framework of FTA. The negotiations on investment chapter of FTA will be based on the U.S. BIT model, which has been updated in 2004. The U.S. 2004 model BIT contains some new features. With respect to the scope of expropriation, the updated model includes interpretive annex providing guidance on the meaning of indirect expropriation, one of the most hotly contested issues in investment treaty arbitration. It also includes provisions under which parties should not weaken the protections afforded in domestic environmental and labor laws as an encouragement for investment. Compared with the U.S. 1994 model BIT, differences also exist in some critical provisions such as performance requirements and scheduling non-conforming measures. This Article reviews those new features and their implications on the Korea-U.S. negotiations of FTA investment chapter. Among the various concerns which can be raised, it focuses on the issues of investment claims, labor, screen quota, and temporary safeguard.
