일제하 조선총독부 기관지의 발행과 법률 관련 자료의 경향
An Analysis of the Publications of the Cho Sun Chongdokbu General and the Trends in Related Legal Documents under Japanese Imperialism

이 논문은 1910년 한일합방 이후 조선총독부가 발간한 기관지인 조선총독부월보와 조선휘보, 조선, 조선어 조선에 게재되어 있던 법률 관련 논설이나 자료들의 내용과 경향에 대해 분석해 봄으로써 일제의 식민지통치가 나타내고 있던 식민지성의 한 측면을 법률적 관점에서 접근해 보고자 한 것이다.조선총독부가 일제시대 전 기간을 통해 다양한 형태의 기관지를 발행하고 있었던 것은 첫째, 한국을 통치하는데 필요한 기초 자료를 수집할 필요 때문이었던 것으로 보인다. 둘째로는 조선총독부가 실시했던 다양한 법률이나 정책의 정당성을 대중들에게 홍보하는데 있어서 잡지형태의 기관지가 유용하게 이용될 수 있다고 판단했기 때문인 것으로 생각된다. 그리고 이러한 상황에서 조선총독부가 발행했던 기관지에는 조선총독부가 시행했던 중요법령에 대한 다양한 논설 및 법률관련 자료들이 게재되어 있는 것으로 파악되고 있다.1910년부터 1930년 중반까지는 주로 총독부가 시행했던 경제관련 법률과 형법관련 법률이 게재되어 있으며, 1930년대 후반 이후에는 전시통제 법령에 대해 입법취지와 법령의 내용이 게재되고 있었던 것으로 보인다.또한 형식적인 측면에서 보면 조선휘보와 조선은 그 발행 규정을 총독부 법령으로 정하고 있었으며, 총독부 각 부서의 관리들로 편집위원회를 구성하고 있었던 것으로 나타나고 있었다. 그리고 이렇게 볼 때 조선총독부 기관지에 나타나는 법률관련 자료를 통해 일제하의 법령 통제가 갖는 사회적 의미를 파악해 보는 것은 의미있는 시도가 될 수 있을 것으로 생각된다.
Abstract
This paper aims to analyze the legal properties of Japanese colonialism through legislative editorials and data carried in 『Cho Sun Chongdokbu Worlbo』, 『Cho Sun Hwibo』, 『Cho Sun』 and 『Chosuneo Cho Sun』which were published by the Cho Sun government-general beginning in 1910 during the annexation of Chosun by Japan. The Chosun government-general produced various publications in many forms throughout the period of colonization. These publications were used, first, as an organ through which the government collected data about Chosun order to control it, and secondly to inform the people of their policies and laws. A variety of editorials and legislative data for important regulations enforced at that time were published by Chosun government-general. While publications from 1910 to the mid 1930s dealt with laws relating to the economy and the criminal code, in the latter half of the 1930s they dealt with wartime regulation and legislation. ‘Cho Sun Hwibo’ and ‘Cho Sun’ both complied with the publishing regulations established by the government-general and their editing committees were composed of government officials from each department. This paper tries to give a meaningful study of the social implication of Japanese legal control in the publications of the Chosun government general.
