도메인이름의 법적보호의 문제점과 개선방향

초록
20세기말 정보화시대 도메인이름이라는 컴퓨터표식이 나타났다. 이것은 초기에는 단순히 편의성을 위해 부여된 것이었다. 그러나 수많이 사람들이 현실공간이 아닌 가상공간에 존재하면서 가상공간에 존재하는 物(컴퓨터나 서버등)에 대한 표식을 필요로 하였고 가상공간의 중요성이 급증하면서 가상공간안에서의 物(컴퓨터나 서버 등)에 대한 표식도 중요한 위치를 차지하게 되었다. 특히 현실세계의 상표나 상호, 영업표지와 관련성을 갖는 경우에는 더욱 중요한 의미를 갖게된다. 메인이름 그 자체의 가치에 대한 중요성은 도메인이름을 둘러싼 많은 분쟁을 야기하게 되었고 이를 해결하는 과정에서 도메인이름 그 자체의 법적 보호의 문제까지 연결하게 되었고 정책과 입법이 각 나라에서 행하여졌다. 우리나라도 이를 위해 인터네주소자원법이 제정되었다. 그러나 이러한 특별법의 제정은 법해석을 통한 합리적 분쟁해결이 아닌 새로운 법적 수단의 강구라는 손쉬운 결론에 도달하고 있다. 도메인이름을 둘러싼 법적 분쟁을 해결하기 위해서는 우선 도메인이름의 법률관계가 무엇인지 밝혀야하고 이를 토대로 논의가 전개되었어야 하며 가장 합리적이고 적정한 수단이 제공되어야 한다. 그러나 우리나라 인터넷주소자원법은 권익침해에 대한 상사적 관점에만 집중하여 현재의 법해석의 노력이 간과되었고 외국법과 달리 현실세계의 기득권자에게 절대적인 보호를 행하므로써 인터넷주소의 공정이용을 저해하고 있다.
Abstract
The function of Domain name is to draw a clear line among computers on network system usually. but domain name have more complex functions, especially similar to the function of trademark it cause disputes over domain name registrants and the trademark registrants the past Domain name register policy was on first come - first served basis. so, cybersquatting appeared. cybersquatting is the act of registering a domain name promarily for the purpose of selling it to the actual owner of a trademark or servicemark for a high price, or to exploit the fame by deliberately attracting many users to specific web site taking full advantage of the similarity with the distinguished trademark or service mark etc. Many countries strived for preventing the cybersquatting, Uniform Domain Name Dispute Resolution Policy(UDRP) is one of the anti-cybersquatting solutions korea makes the internet address resources law as anti-cybersquatting solutions too. it is perfect protection system for only trademark registrants, because it have not exceptional use as like the provision of UDRP § 4. It have another problems, the second problem is that the legislators has no deep regard for other laws surely. the third problem is misunderstanding of the legal nature of Domain name To make short of a long story on Korea‘s internet address resources law is "Too much is as bad as too little" I propose that the law should have the exceptional provision
