제3자의 부정행위 가담으로 인한 불법행위의 성립

종래 배우자의 일방이 부정행위를 하고 이에 가담한 제3자가 있는 경우 타방 배우자의 그 제3자에 대한 손해배상청구를 인정하였다. 이러한 경우 사건의 쟁점은 그 행위가 부정행위가 되느냐에 달려 있었고 따라서 언제나 부정행위의 개념이 문제였지 그것이 과연 위법한지에 관하여는, 일본에서 부정설과 제한적으로 해석하는 견해가 유력하게 주장되는 것과 달리 우리나라에서는 별 이견 없이 시간이 흘러왔다. 부정행위의 개념을 이와 같이 이해하게 될 경우 제3자의 행동의 자유를 과도하게 제약하게 되며, 다른 배우자의 혼인의 형성, 유지, 해소의 자유를 침해하게 된다. 따라서 당사자 사이에 이혼원인을 판단하는 문제와 제3자에 대하여 책임을 묻는 문제는 구별되어야 하며, 부정행위의 개념이 과연 법률적으로 어떻게 이해되어야 하는지에 관하여 진지한 검토가 필요하다. 이 글에서는 부정행위의 개념을 검토하고, 불법행위로서 다루어야 할 제3자의 행위를 성적, 육체적 관계로 제한하며, 그것이 위법하다고 평가되기 위하여는 제3자가 주관적으로는 적극적인 가정질서 파탄의 의사를 가지고, 객관적으로는 그 방법이 사회상규에 반하여야 한다는 기준을 제시한다.
Abstract
If a husband or wife did an unfaithful behavior like an adultery, and there was a third party whom had art and part in that behavior, the other spouse could demand damages against the third party. In this case, the issue was hanging whether the behavior was unfaithful or not, and, therefore, always a concept of an unfaithful behavior was a problem, and time has streamed without any different view about it's illegality unlike Japan where negative or restrictive opinion is influential. If the concept of an unfaithful behavior is understood like that, the freedom of an action of the third party will be restricted excessively and for the other spouse, the freedom of formation, maintenance and solution of a marriage will be infringed. Therefore, the problem of demanding damage should be distinguished from judging the divorce cause, and we should make careful consideration to the concept of an unfaithful behavior. I will examine the concept of an unfaithful behavior, limit an act of a third party to a grade, sexual and physical relationship, and present criteria for illegality; subjectively, the third party has aggressive intention to break the family, and objectively, the way is in contravention of social established rules.
