언론보도에 대한 공적기관과 공적인물의 법적 대응에 관한 법원의 판결 분석

노무현대통령의 참여정부는 집권기간 내내 언론의 비판보도에 대해 민감한 반응을 보여 왔다. 이 같은 분위기 속에 공적기관이나 공적인물들이 법원에 반론(정정)보도심판청구나 손해배상청구소송을 제기하는 사례도 이 정부 들어 크게 늘었다. 이 연구는 법원의 판결 분석을 통해 공적기관과 인물의 언론대응의 적절성 여부를 검증하기위해 수행되었다. 이 연구에서는 대법원의 2002년 1월 22일 민주노총 사건 판결 이후에 공적기관과 공적인물이 언론을 상대로 제기한 손해배상청구소송과 반론(정정)보도청구소송 중 판결이 이루어진 67건을 분석대상으로 했다. 분석결과 법원은 언론의 권력에 대한 감시와 비판 기능의 중요성을 일관되게 지지하고 있었다. 또 언론사에 사실 확인과 검증노력을 줄기차게 요구하고 있으며 만약 언론이 이를 소홀히 한 것으로 드러났을 때는 가차 없이 책임을 묻고 있는 점이 확인됐다. 정정보도심판청구의 경우 법원은 대법원의 공인 법리와 상당성 법리를 매우 적극적으로 수용하고 있었다. 반면 반론보도청구의 심사에 있어서는 반론을 구하는 내용이 ‘명백히 사실에 반하는 경우’가 아닌 한 기계적으로 이를 인용하는 태도를 보였다. 법원은 또 신청인의 당사자적격에 대해서는 전혀 문제 삼지 않는 태도를 보였다. 아울러 여러 판결문의 문맥에서 공적기관과 공적인물이 언론을 상대로 적극적으로 소송을 제기하는 데에 대한 법원의 우려를 엿볼 수 있었다.
Abstract
This study aims to examine legal counteractions of the government, public offices and public officials against the press by analyzing judicial decisions. The 67 cases that are analyzed in this study are lawsuits for torts and lawsuits for corrected or contradictory statement filed by public offices and public officials against the press, that were declared after the judgement of January 22 2002. The results show that the courts consistently support the importance of the role of media to observe and criticise the government. The courts also constantly demand the press for identification and verification of facts, and if these qualities are found to be lacking, the responsibility is strictly called into account. In case of the lawsuits for corrected statements, the courts actively embraced the precedents of the Supreme Court regarding public figures. However, in judging lawsuits for contradictory statement, the courts accepted the cases mechanically unless they are proven to be 'strictly against the fact.' The courts also do not make an issue of the petitioner's standing. In addition, the court's concern over the aggressive litigations of the public offices and officials against the press can be found in several rulings of the court.
