입법 지연 및 갈등 극복에 관한 연구

초록
정부의 부처간 갈등이나 국회에서의 심의 의결지연으로 인하여 행정부에 대한 국민적 신뢰 저하와 행정력의 낭비가 발생하는 빈도가 최근 자주 나타나고 있다. 이는 정당들을 중심으로 한 정치적 갈등과 정쟁이 주된 원인인 경우가 대부분 이라고 할 수 있을 것이지만, 법률제정절차와 같은 입법과정에서의 문제 또는 입법갈등을 조정할 수 있는 제도적인 부재로부터 비롯되는 원인도 적지 않을 것으로 볼 수 있다. 입법지연은 대체로 국회 내부적 환경과 문제로 인하여 발생하는 경우라 할 수 있겠으나, 행정부처간의 갈등으로 인하여 발생하는 경우도 적지 아니하다. 법률의 제정 또는 개정에 따라 이를 적용하여야 하는 정부 부처 간에는 이해관계가 충돌하는 경우가 나타나며 이는 정부간 갈등으로 비약하게 되며, 종국적으로는 정부입법 형식으로 발의하여야 할 시기를 상실하게 된다고 할 수 있다.우리나라에서는 정부 내에서의 부처간 갈등을 사전에 조정해소하기 위하여 정부입법계획제도를 시행하고 있다. 법제처의 정부입법계획제도와 운용은 이러한 제도적 문제를 보완하는 장치가 되고 있으나, 그 제도적 취지에도 불구하고 그 유용성에 있어서는 아직까지 소극적으로 보고 있는 경향이 있어 충분한 성과를 보여주지 못하고 있는 것이 사실이라 할 수 있다. 우리나라에서는 입법과정에서 일원적인 절차만 규정하고 있으나, 프랑스 헌법에서 보는 바와 같이 입법과정 자체에서 긴급성을 대비한 단축절차제도의 도입이나, 입법과정 전반에서의 행정부 참여를 위한 제도, 행정부가 스스로 법률적 지위에 해당하는 명령 즉 법률명령을 발할 수 있는 제도의 도입과 같은 것을 모색해 볼 수 있을 것으로 보여진다. 또한 행정부 내에서도 법률 뿐만아니라 성문법규범 전반과 판례 등에 관한 최신의 법률적 이론과 지식으로 법적인 지원을 행하는 법률전문가들의 집단인 행정부 총무국제도와 국참사원제도와 같은 국가기관은 정부입법의 갈등을 원만하게 조정하고 통합하는 기능을 수행하기에 충분한 것으로 우리에게 시사하는 점이 크다고 할 것이다.
Abstract

It was due to a party feud or retarding legislation in the government.Retarding legislation is made to the inside problem or enviroment of the National Assembly and to a party feud. It make appearnce Among government agency to collision of interests. This is make rapid progress to troble among government agency, and finally loss time of lawmaking a proposal.The government legislative plan come into effect for mediation or settlement of discord in Korea government.The government legislative plan and its working of the Office of Legislation make a safety device to complement this systemic problem.Nevertheless the intent of system, it is fact that the government legislative plan do not show a enough result.A legislative process enact procedural unification in Korea. However the France constitution enact reduction system of process for an emergency of lawmaking a proposal, participation system of the administration in whole lawmaking a proposal, the system which can announce laws and regulations.And so France administration have system of 'Conseil d'Etat' and 'Secretaire General de Gouvernement'. This have function to mediation and unification of discord in government legislation. It is full of suggestions to us.
