Effective Cooperation Regime for Marine Scientific Research in North East Asia

Pure marine scientific researches have increased the mankind's knowledge of the ocean, but in reality some States deny the existence of the notion of pure research itself. It is partly because some researches have been conducted by with the base intention to expand national jurisdictions. The project of the research planned by the Japanese government to be conducted in the East Sea in April, 2006 was one of the examples faced with acrimonious distrust and hostility from the neighbouring country, Korea. The consecutive incidents caused by the project contributed to increase the interest in the regime for marine scientific research, but the time has become ripe for the concerns about the possibility to hinder the project with good cause. The main object of this paper is to suggest some options of the effective international cooperation regime for pure marine scientific research to remove the concerns. To this end, the paper examines 1) the sources of international law regulating on the international cooperation regime, 2) existing global and regional organisations, and 3) the practices of China, Japan and Korea concerning the cooperation, and then suggests the acceptable cooperation models for the enhancement of marine scientific research in the Northeast Asia. When the incidents between Japan and Korea happened, Japan suggested in the negotiations to establish prior-notification for the project conducted in disputed sea areas. The paper, therefore, addresses the pros and cons of the establishment of the prior-notification suggested by Japan.
