상법 제732조는 15세 미만자, 심신상실자, 심신박약자의 사망을 보험사고로 하는 보험계약을 무효로 하고 있다. 오랫동안 유지되어 왔던 이 조항에 대하여 2005년 국가인권위원회가 법무부에 그 폐지를 건의한데 이어 최근 의사협회와 일부 시민단체들이 폐지론에 동조하고 있으며, 2007년의 법무부의 상법개정안은 개정의견을 부분적으로 수용하였다. 이에 따라 심신박약자의 경우, 보험계약체결시 의사능력을 지니고 있으면 보험에 가입할 가능성이 생겼다. 그러나 보험자와 사업자단체는 이 조항의 개정에 반대하고 있다. 본고는 이에 대한 국내의 논의상황과 외국의 경우를 살펴보았다.상법 제732조는 15세미만자, 심신상실자, 심신박약자의 생명을 인위적 살인 등 도박적 위험으로부터 보호하려는 규정으로써 그 역할을 과소평가하기는 어렵다. 더구나 우리 상법이 금지하는 것은 사망보험이나 생사혼합보험인 것이고 사망보험은 타인을 위한 보험계약이므로 이들의 사망사고로 인한 보험금은 피보험자 자신에게 지급되는 것이 아니라 유족 등 보험수익자에게 지급된다. 정신상태가 불완전한 이들을 인위적 사고의 위험에 방치하여 두고 이들로부터 수익하는 것은 인권정책상으로도 맞지 아니한다. 그러므로 동조의 전면폐지보다는 실무상 동조의 악용사례를 막을 수 있는 방안을 강구하는 것이 더 좋다고 생각한다.
Abstract
The Commercial Code article 732 provides that the prohibition of the insurance contract for those under 15 years of age, etc. By this article, a contract of insurance which assumes the death of a person under 15 years of age, of a feeble-minded person or a person who is mentally unsound as the insurance risk shall be null and void. This article amended by Law No.4470, Dec. 31, 1991. In 2005, National Human Rights Commission of Korea recommend that Ministry of Justice to abrogate the Commercial code sec. 732, And in 2007, National Action Plan for the Promotion and Protection of Human Rights include this as a major task.In 2007, the Ministry of Justice announced the Commercial Code revised bill comes following the recommend of NHRC include partial amend of sec. 732. Some Psychiatrist and Korean Medical Association support the draft but insurance company and business association have an opposite view. The author weigh up the pros and cons. The amendment opinion's ground is anything but convincing. Art. 732 prevent feeble-minded person from the serious moral risk. After insured's death, the insurance money was paid not to feeble-minded person but to beneficiary. The author emphasize to promote the underwriting practice and develop new policy for disabled person.
