연구개발 지원정책의 WTO보조금협정 합치성 연구

초록
1990년대 이후 지식기반경제가 성숙단계에 들면서 핵심 산업경쟁력의 가장 중요한 결정요소로 첨단기술력이 대두됨에 따라 선진국들을 중심으로 대부분의 국가들이 R&D 역량 강화에 정부지원정책의 초점을 맞추고 있다. 우리 정부의 경우에도 기존에 시행해오던 생산 관련 직접지원 형태에서 탈피하여 기술력 제고에 필수적인 연구개발 지원에 보다 치중하고 있다. 한편, 이처럼 정부의 연구개발 지원이 규모와 범주면에서 확대됨에 따라 이에 기초한 통상마찰도 점차 증가하고 있는데 최근 WTO차원에서 제기되는 연구개발지원과 관련된 보조금 분쟁은 향후 대부분 WTO회원국의 산업정책은 물론이고 특히 첨단산업 육성에 주력하는 우리에게 매우 중요한 시사점을 제공할 것으로 보인다. 이러한 측면에서, 캐나다 정부가 시행한 대표적인 연구개발사업인 Technology Partnership Canada하의 항공기산업 지원에 관한 WTO 분쟁은 우리의 차세대성장동력사업을 비롯하여 정보통신 부문의 IT839전략 등 연구개발 육성 전략을 진행하는데 있어 매우 중요한 선례가 되고 있다. 무엇보다도 최근 조기 상용화를 통한 산업적 성과를 부각하기 위해 연구기관보다는 산업체 중심의 연구개발 프로그램 추진이 선호되거나 상용화에 근접한 기술의 실제 응용화를 촉진하기 위한 연구개발 지원의 확대 등은 현재 날로 강화되고 있는 국제통상규범의 현실에 입각하여 신중한 재검토가 요구되는 부분이다. 연구개발 역량 강화는 21세기 세계화를 기초로 한 글로벌 경쟁을 극복하고 우리 경제를 한 단계 승급함으로써 명실상부한 선진경제로 발전시키는데 핵심적인 사안이다. 따라서, 중장기적인 비젼과 계획에 입각하여 추진하는 정책인만큼 국제통상규범의 합치성을 면밀하게 검토하여 불필요한 통상마찰을 야기할 위험을 최소화하고 안정적인 정책 시행을 위한 정책환경을 확보하여야 할 것이다.
Abstract
When WTO Members engage in a more fierce industrial competition, especially in technology intensive industry sectors, research and development(R&D) subsidy policies have gained far more attention in terms of consistency with the WTO disciplines. In fact, there were already several countervailing cases which included the determination of countervail able subsidies concerning R&D subsidies rendered by the US government. In the Canada - Aircraft case in the WTO dispute settlement system, the alleged R&D subsidy by the Canadian government was found to be an export subsidy that was legally prohibited without any exception. All these cases seem to provide an important implication for the recent subsidy policies aggressively promoted by the Korean government in the recent years. Like many other WTO Members, the Korean government also put a great deal of emphasis on research capacity for future industry development since it is directly related to technology development and invention which are the core element of industry success. By reviewing the legal decisions regarding R&D subsidies, this paper shed some light on the direction for future R&D policies in Korea.
