헌법상 교육자치의 법리와 지방교육자치법의 입법과제

각국의 교육제도는 그 나라 고유의 교육환경과 역사적 배경을 가지고 있으며, 이를 보장하기 위해 헌법과 법률에 법적 근거를 마련해 두고 있다. 우리의 지방교육자치는 명목상 제헌헌법부터 보장되어 왔으나, 1991년 지방교육자치에관한법률의 제정을 통해 본격화되었다고 할 수 있다. 그런데 2006년 말 개정된 지방교육자치에관한법률은 지난 10여년 동안 실시된 지방교육자치제도의 문제점을 해결한다는 미명하에, 지방교육자치의 본질과 특성은 무시된 채, 우리의 지방교육자치가 선진국과 다르다는 이유로, 또한 새로운 제도를 만드는 것이 기존 제도의 문제점을 모두 해결할 수 있다는 행복한 상상 속에서 이루어진 개정으로 법적 안정성을 고려치 못한 개정이었다고 판단된다.특히, 헌법 제31조 제4항에 의해 보장된 교육자치를 구체적으로 실현함에 있어 입법권자의 입법재량이 허용된다고 해도, 자치의 본질인 자치사무, 자치입법, 자치재정을 최대한 보장할 수 있는 범위내의 입법재량이 행사되어야 한다는 한계에 대해서는 충분히 고려하지 못한 것은 아닌지 의문이다. 이 글은 이와 같은 문제인식에서 출발하여 우리 헌법이 보장하고 있는 지방교육자치의 본질이 무엇인지를 살펴보고, 이를 토대로 한 지방교육자치법의 입법과제가 무엇인지 검토해 보고자 하였다.
Abstract
The Education Autonomy is based on the independence and professionalism of education in Constitution Article 31 ④. It means that the self-determination of the interested Person on the education, and it is included to local education autonomy system, school autonomy, class autonomy. The local education autonomy system is a pattern of the education autonomy, and some scholar, and the constitution court assert that it is the extension of local autonomy, local autonomy is the part of region autonomy, edcation is the part of field autonomy, so it is dual autonomy. Local Educational autonomy Law introduce in 1991, and is try to review and amend it for resolving the problem of the local educational autonomy system. In Dec. 28. 1996, it is amended for resolving the problem of local educational autonomy system, so that, it is the problem of duplicate consulting council and authority of audit and so on. It's amendment is not for guarantee of the education autonomy, but for the efficiency of administration. So it is short for resolving of the essential problem in education autonomy. So, I assert that it is important for ensuring education autonomy of guarantee the right to autonomical legislation, and right to autonomical finances, and it need to another amendment for them.
