포털사이트의 뉴스서비스의 법적 고찰

대부분의 포털사이트에서는 뉴스서비스를 제공하고 있는데, 뉴스서비스의 제공이 단순히 언론사로부터 제공된 뉴스를 단순히 전달하는 정도를 넘어서 언론사가 제공한 뉴스에 대하여 자의적인 뉴스의 가공을 통하여 뉴스를 전달함으로써 포털사이트는 새로운 뉴스서비스 제공의 수단으로 역할을 하고 있는 것이 현실이다. 이에 따라 포털사이트의 뉴스서비스를 언론의 일종으로 보아야 한다는 주장이 강력하게 제기되고 있다. 현행 신문법과 언론중재법에서는 인터넷 신문이라는 용어를 사용하여 인터넷을 통한 전자간행물을 신문의 종류에 포함시키고 있다. 그러나 ‘독자적인 기사생산’이라는 요건을 요구하고 있으므로 포털사이트의 뉴스서비스는 언론에 포함되지 않고 있다.전통적인 의미에서 언론이 되기 위해서는 취재, 편집, 배포라는 세 가지 요소를 필요로 한다고 정의되고 있다. 취재와 관련하여 대부분의 오프라인 언론사도 다른 통신사로부터 기사를 공급하여 자신의 신문에 게재하고 있으므로 포털사이트가 독자적인 취재를 하지 않기에 신문에 해당하지 않는다는 주장은 타당성이 없다고 할 것이고, 편집과 관련하여 포털사이트가 공급된 기사를 취사선택하고 기사의 제목을 변경하며 자신의 구미에 맞는 기사를 중심으로 공급하고 있는 상황이라면 일종의 편집권을 행사하고 있다고 보아야 할 것이다. 배포와 관련하여 포털사이트의 배포능력은 기존의 언론사보다 월등하다고 할 수 있다. 기존의 언론사로부터 거의 모든 기사를 제공받아 인터넷을 통해 인터넷에 접속한 누구에게나 정보를 전달할 수 있다면 언론의 요소 중 가장 중요한 “강력한 전파력”을 가지고 있는 포털사이트를 언론이 아니라고 단정하기는 어려울 것이다.전통적인 언론의 개념만으로 현재의 포털사이트의 뉴스서비스를 바라보는 것은 타당하지 않으며, 포털의 사회적 책임을 강조하는 현 시점에서 포털사이트의 뉴스서비스는 언론에 해당한다는 적극적인 방향으로의 전환이 필요하다 할 것이다.
Abstract
Under the Newspaper Act and the Arbitration of Media and Relief of Damages Act, the news services provided by portal sites are not deemed as press. Some studies, however, have argued that the portal sites' news services shall be considered at press because of their increasingly proactive role in providing news services. This paper analyzes the aspects of portal sites' news services with a view to developing legal bases for the extended definition of press. We argue that the portal sites' news services meet three conditions for being deemed as press: collection of news materials, editing and distribution. First, since, like the off-line news providers, the portal sites collect news materials through news wire services, it is not reasonable to claim that they are not press because they do not collect news materials through their own network. Second, since they edit the collected news materials and since they also change headlines of news articles, they should be considered as press. Third, since they can distribute news to anyone who accesses to the sites, they have powerful capacity to distribute news. Therefore, it is a need to take into account the news providing functions of portal sites from legal point of view.
