일본의 전자상거래 및 정보재 거래 등에 관한 준칙(2007.2.)의 분석 및 한국 디지털 통칙의 제정방향

The emergence of the internet has resulted in the creation of new models of economical activities such as electronic commerce. However, since most of the existing laws, includingthe Civil Code, were established before the emergence of such new technologies, the interpretation of the application of the existing laws concerning electronic commerce are not necessarily clear. There is still no legal environment for electronic commerce in which the parties can participate in complete security. Interpretative guidelines of Japan are intended to explain how the relevant laws and regulations including the Civil Code are applied and interpreted with respect to various types of legal problems in the field of electronic commerce and to promote facilitation of transactions by enhancing predictability for the parties involved. Interpretative Guidelines on Electronic Commerce of Korea also highly need to be established at this moment.In order to achieve this objective, this paper takes the following steps in carrying out in argument. This paper starts by taking a look at the significance and characteristics of Interpretative Guidelines on Electronic Commerce and Information Property Trading of 2007 Japan version. Stocktaking of & future direction of Interpretative Guidelines on Electronic Commerce of Korea will be followed.
