변호사의 비밀유지의무와 진실의무

늘어나는 변호사들로 인하여 변호사 시장은 점점 더 치열해져 가고 있다. 이로 인한 법률시장의 치열한 경쟁 더 많은 의무의 충돌과 윤리문제가 발생할 것이다. 변호인은 의뢰인을 보호할 의무와 국가사법권의 적정한 실현을 도모할 공적인 의무간의 충돌이라는 피할 수 없는 상황에서 무슨 의무를 우선해야 할지는 결국에는 형사변호권의 한계문제와 결부되며 변호사 윤리문제와도 직결된다. 이는 결국 피고인의 보호자라는 지위를 기본으로 하고 공익적 지위는 그 한계로서 소극적 의미를 갖는다는 점을 고려하면서 공정한 재판의 이념에 따라 변호인은 법률상 허용되지 않는 수단이나 국가의 법질서에 반하는 변호활동을 할 수 없다는 선에서 해결하여야 한다. 변호사 자신들을 위한 변호사제도가 아니라 국민을 위한 변호사제도가 되어야 할 것이다. 이를 위해선 먼저 법조인들 스스로 법조비리를 척결하고 국민들에게 신뢰를 회복하여야 한다. 그리고 변호사법, 변호사윤리규정 등을 개정하는 등 법조윤리를 확립하여야 한다. 그 구체적인 방안으로 현행 변호사법 등에서 변호사의 권한과 책임에 관한 사항을 강화하고 구체화하여 비밀유지의무와 진실의무가 충돌하는 경우라든지 기타 변호사의 윤리적 갈등에 속하는 사안들에 대한 구체적 기준을 설정해야겠다. 회사변호사의 책임과 의무의 충돌에 대해서도 미국의 변호사윤리규칙과 같은 구체적 입법은 반드시 필요할 것이다.
Abstract
The competition in lawyer market is becoming keener with a growth of the number of lawyers. The circumstance of this competition will bring about the dilemma to lawyers in legal ethics and the conflict of professional responsibility. Duty to Tell the Truth should be come from a public 'guardian' status. Criminal lawyers' duty is different from that of prosecutors who should be in pursuit of substantive truth. That is, the public 'guardian' status of criminal lawyers finds its distinction from that of prosector in that the former puts first and forefront priority on its clients' best interests and secure the substantive truth within the scope of the process through continuous struggles with courts and prosecutors. In this sense, it may well be that criminal lawyers are obliged to be more aggressive and thorough in protecting their defendant clients based on duty to protect their clients which preempts the duty to tell the truth. Lawyers in the criminal procedures have Duty of confidentiality and Duty to Tell the Truth. Duty of confidentiality is come from the lawyers' status to protect their client. Lawyers must communicate with the client in confidence, confidentiality must have been maintained. The content of the communication, as opposed to the facts communicated, must be secret. Lawyers must not disclose the secret of their client. But they can exceptionally disclose the secret of their client. We should do ours best to settle the problem that Duty to Tell the Truth conflicts with Duty of confidentiality. A establishmen of the legal code for lawyer's professional ethics is urgently called for. The legal code for lawyer's professional ethics should be calibrated balance between competing duties.
