국가 정보화 법제 개편방향에 관한 연구

초록
우리나라는 정부가 주도가 되어 국가사회 정보화를 추진한 연유로 정보화를 추진하고 지원하기 위한 법제도의 영역이 타 국가에 비하여 상대적으로 광범위하게 분포하고 있으며, 그 법률의 수도 많다. 초기, 정보화의 미성숙 도입단계에서는 국가사회 정보화 정책을 중앙집권적으로 단일의 법률에 의하여 추진하였다. 그러나, 정보화가 성숙하게 됨에 따라 정보기술(IT ; Information Technology)은 국가사회의 각 부분에 내재되어 각 영역을 변화시키는 핵심 도구로 사용되게 되었다. 이를 위하여, 각 영역에서의 법제도 정비가 활발히 이뤄졌으며, 정보화 관련 법률을 광범위하게 분포하게 하는 계기가 되었다. 그러나, 이는 영역 간 중복으로 인하여 개별 법률간 충돌을 야기시켰으며, 오히려 국가사회 정보화의 원활한 추진에 장애를 초래했다. 즉, 불필요한 규범경쟁과 정책충돌을 야기시켰다. 전자정부와 국가사회정보화 법체계의 충돌, 디지털콘텐츠정책의 상충은 그 대표적인 예에 해당한다. 이러한 측면에서, 금번 정부조직개편은 규범 과다로 인한 비효율성 타파를 염두한 강력한 경종이다. 정부조직법 개정 및 정부업무 재편성을 기화로 정보화 법제 체계 전반에 대한 반성과 새로운 시대와 환경에 걸맞는 정보화 법제 체계에 대한 숙고가 필요하다고 본다. 이하에서는 우리나라 정보화 법제의 발생부터 현재에 이르기까지의 연혁과 소위 ‘정보화 법제 群’에 대한 분류를 기준으로 정보화 법제의 현황과 문제점을 살피고, 새로운 환경을 수용하고 이끌어갈 수 있는 정보화 법제의 개선 방향과 구체적인 정보화 관련 법령의 제개정 방안을 제시하고자 한다.
Abstract
Korea's 'Informatization' today is appraised as a success model in the international arena. That is due to constant efforts by the government. Korea government & assembly have made a lot of IT Law which supports IT Policy strongly. As a results, IT Law has been tailored fit the every aspect of our society. For example, Framework Act on Informatization Promotion, Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. Now on, IT Paradigm has been changed, IT is embedded into all of life & society. IT is essential necessity to our daily living. The surroundings of IT Policy & Law is largely changed, in comparison with the IT's Introduction periods. At this point, IT Law needs innovational revision and reorganization. The RheeMuyngbak' cabinet pinpointed the necessity of IT Law's innovation abovementioned. IT Law should discard the nonsystem and the disutility. Every aspect of IT Law [⑴Infra, ⑵Service ⑶Industry ⑷Copyright ⑸Ethics(contains personal information protection)] is rationalized in step with IT Paradigm shifting. At the end, This study proposed 6 bills which preparing and leading "The Future Knowledge Information Society". There are "Fundamental Act on Future Knowledge Information Society(enact)", "E-government Act(revise)", "Coyright Act on Information Society(enact)", "Broadcasting and Communication Service User Protection Act(enact)", "Basic Act on Personal Information Protection(enact)", and "Information Society Safety and Security Act(enact)"
