출자총액제한제도의 변화요인 연구: 공정거래법 제정(`04.12.31) 사례를 중심으로

본 연구는 출자총액제한제도(이하 출총제)의 변화요인으로서 정책 목표･성격의 모호성, 대통령의 정책의지, 이해관계의 대립, 설득전략으로서의 상징을 제시한다. 그리고 공정거래법 개정사례(’04.12.31)를 중심으로 출총제의 부정적 의미가 형성되고 정책문제로 인식되는 과정 및 전경련 등의 언어적 상징기제를 분석한다. 위로부터의 정책변화 사례라고 평가받는 출총제는 참여정부 이전에 개정, 폐지, 재도입, 재개정 등으로 급격하게 변화해왔다. 하지만 참여정부의 두 번의 공정거래법 개정사례에서는 과거와 다른 모습이 나타났다. 특히 첫 번째 사례(’04.12.31)에서는 대통령에 대한 국회의 탄핵소추와 극적인 복귀 등으로 대통령의 정책의지가 제한되고, 출총제 폐지와 유지 입장 간의 갈등상황에서 개정이 이루어졌다. 또한 출총제의 모호성 때문에 실제적인 정책가치가 불분명한 상황이었다. 이러한 상황에서 폐지입장의 상징전략은 출총제의 부정적 의미를 형성하고 이를 정책문제화 하였으며, 이에 따라 폐지･완화에 대한 국민공감대를 바탕으로 공정거래법이 개정될 수 있었다.
Abstract
This study presents changing factors of "Ceiling on Total Amount of Share-holding in Other Domestic Companies(CTASODC)" that are ambiguities of public policy, a presidential policy intention, conflicts of interests, and symbolism. It is focused on the Cases of Revised(’04.12.31) Monopoly Regulation and Fair Trade Act. This study explores linguistic symbolism of the FKI. And It is studied for the process of negative meanings, that "CTASODC" is recognized as policy problems. The "CTASODC" had changed drastically from Revision, Abolition, to Re-introduction and Re-revision. But It is changed differently in the Participatory Government. Particularly, The first Revision Case(’04.12.31) is unique compared to the past. The reason is that the congress impeachments restrict a presidential policy intention, and that abolition position between preservation position conflict intensely. The "CTASODC" is characterized by the ambiguities. In addition, The abolition position(FKI) uses for symbolism that result as negative meanings and policy problems.
