개인정보보호 관련 법제에 대한 입법평가 연구

Now in Korea, Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. is doing its function as a general law of protection of personal data in civil sector. But its regulations are too strong to activate information-flowing and develop the industry concerned. Such is based upon social value out of balance. This article explores how existing debate on personal information is partial to data protection to reestablish equilibrium of constitutional order in information for propriety of act on protection of personal data in general. In this article, we can speculate legislative direction of fundamental law related to personal data protecion, to information order analogically based upon constitutional spirit. From this point of view, there are reappraised the present condition of legalization on personal data protection from guaranteeing rights and interests of information subject in this treatise. Hereupon it refers to complementary discussion to observe the a few legal issues on CCTV(closed-circuit television) for legislation-revaluation of Act on Protection of Personal Information Maintained by Public Agencies, from this angle of vision.
