초록
미국형사절차의 두드러진 특색은 연방과 주의 二元的 법체계를 중심으로 배심제도와 당사자주의 및 엄격한 증거법칙이 지배하는 공판중심주의로 볼 수 있는 바, 미국은 형사재판에서도 민사재판의 원ㆍ피고와 같이 검사와 변호인이 상호 대립하여 주장과 입증을 하고, 판사는 마치 운동경기의 심판처럼 중립적으로 재판을 진행하는 Adversary System이 철저하게 유지되고 있다. 그리고 기소인부절차와 답변거래(유죄협상제도)는 당사자주의에 입각한 것으로서 피고인이 답변거래를 거쳐 기소인부절차에서 유죄답변을 하면 배심에 의한 유죄평결이 있는 경우와 동일한 효력이 발생하고, 이 경우 엄격한 증거법칙이 적용되지 아니하므로 법원은 증거조사없이 판결을 선고한다. 다만 미국의 당사자주의적 사법절차는 어떠한 사안의 실체적 진실을 파악하는 것이라기보다는 당사자들에 의하여 제시되는 각종 자료를 기초로 하여 당사자간의 분쟁을 해결하는 것이 목적이므로 소송절차가 개시되기 전(前)단계에 있어서 철저하고 객관적인 사실관계에 대한 규명절차가 없다. 결국 미국의 연방국가적 특성에 따른 법제도의 다양성 때문에 미국의 제도를 정확히 이해하기 어려운 점이 많지만, 연방이나 주를 막론하고 미국 형사절차법과 관행에 흐르고 있는 근본이념은 실용주의와 합리주의에 입각한 조화와 견제라고 볼 수 있을 것이다.
Abstract
As a body of investigation, prosecutor in korea takes the initiative and directs the police on criminal booking, case transfer to prosecutor, police arrest and detention, and application of law. The status of prosecutor as a principal in investigation is stated in the Criminal procedure Code. According to the code the police are assisting prosecutors in investigation. Recently, in order to investigate independently of prosecutor, the police have tried to amend the Criminal procedure Code. In America, the prosecutor provides legal advice to the police, and the police may seek legal advice from the prosecutor as to the conducts of an investigation and the legal implications or requirements of a specific investigative step. For example, the prosecutor could advise that a particular proofs is necessary in relation to a particular type or charge or offence, which may influence the police in their investigation. However, ultimate responsibility of investigation lies with the police force. The general procedure in relation to prosecutions is that the police carry out investigation and upon completion of an investigation will then submit a file to the prosecutor. But the leading role of the prosecutor in America - not so much a matter of command as of responsibility - acquires its full importance in American’ legal systems, because the public prosecutor is responsible for ensuring that procedural rules are observed from the investigation to trial enforcement.
