선하증권 전자화에 따른 법적 논점의 재검토

Revised Commercial Code provides that the electronic bill of lading is in force by means of registering in the title registry instead of issuance. Futhermore, the electronic bill of lading has legal force as the Bill of Lading. The electronic bill of lading which contains a name of consignee is a negotiable bill of lading even if it does not contains the wording ‘to order of’ and it is transferable by endorsement or delivery. However, in the electronic bill of lading, a straight bill of lading is required to be assigned by notifying a carrier. Furthermore, it is a question whether the straight bill of lading is a document of title or merely a receipt of goods that contains on carriage of goods. The recent increasing use of the straight bill of lading qualified as a ‘similar document of title’, necessitated more separate treatment from that of the sea waybill. These problems can be reviewed from legal and practical aspects, respectively.
