국제사회의 국제법과 지구시민사회의 만민법: 유럽인권협약을 중심으로

초록
이 논문의 기본테제는 지구시민의 법인 만민법은 결국 국제사회의 법인국제법을 통해 실현될 수밖에 없다는 것이다. 이는 만민법(law of peoples)과 국제법(international law)의 형식적 구분을 전제하고 있다. 형식적 의미에서 만민법은 모든 사람들에게 유효한 법으로, 국제법은 국가 간에 유효한 법으로 이해된다. 위의 기본테제는“유럽인권협약(EuropeanConvention for the Protection of Human Rights and FundamentalFreedom)”의 사례에서 입증된다. 유럽인권협약이 위의 테제를 입증할 사례연구로 유효한 근거는 다음과 같다. 유럽인권협약은 국가 간의 협약이라는 측면에서 국제법적 성격을 지니고 있지만, 그 협약의 내용이 보편적 인권이라는 점에서 만민법적인 특성을 보이고 있다. 유럽인권협약은 국제법과 만민법이 서로 겹치면서 공존하는 영역에서 구현되고 있기 때문에 국제법에 의하여 만민법이 어떻게 효력을 지닐 수 있는지 포착할 수 있는 좋은사례가 되는 것이다. 고찰의 순서는 다음과 같다. 우선 국제사회, 국제법,지구시민사회, 만민법이 무엇인지 그 개념을 살펴본 후에 이러한 개념을기초로 해서 유럽인권협약을 분석하고 그 협약에 담겨 있는 국제법적 요소와 만민법적 요소를 다루어 볼 것이다. 이러한 과정에서 보편적 인권으로이해되는 만민법은 결국 국제사회의 국제법을 통하여 법적 효력을 지니게된다는 것을 알 수 있다.
Abstract
According to the basic thesis of this article, law of people could be realized after all by international law of international society. This argument is based on the assumption of a formal differentiation between law of peoples and international law, by which law of peoples is understood as the law that is valid for all peoples, and international law as valid norms between states. The basic thesis will be justified by a case study of ECHR (European Convention for the Protection of Human Rights and Fundamental Freedom). ECHR shows us the both sides of law of peoples and international law. The procedure of inquiry is here as follows. First, we deal with the question of “what is”, that is, the definition of international society, international law, global civil society, law of peoples. Second, on the basis of these definitions we will study the case of ECHR. In this way we would understand that law of people could be valid after all by international law of international society.
