초록
북한은 1998년 헌법 개정 이후 1999년 3월 24일 ‘민법’을 개정하고, 2002년 이후 3차례에 걸쳐 ‘민사소송법’을 개정하였으며(2002년 10월 24일, 2004년 12월 7일, 2005년 10월 25일), 2001년 8월 22일 ‘손해보상법’을 제정하는(동법은 2005년 4월 19일 개정) 등 민사법(民事法)의 개변(改變)을 하였다. 더욱이 2002년 7월 1일 북한이 단행한 경제관리개선조치는 특히 재산법의 운용에 변화를 가져올 것으로 전망된다.이에 본 논문은 재산관계를 규율하는 실체법인 북한 민법을 중심으로 종래의 모습에 비추어 최근에 변모된 북한 민법의 내용과 그 특색을 살펴봄으로써 남북한 민법의 접근가능성을 모색하고 있다. 특히 북한 민법총칙의 변모와 그 특색으로는 공민의 행위능력과 관련하여 금치산자에 관한 규정을 신설한 것, 법인설립에 있어서 등록을 성립요건으로 하고 있는 것, 다른 나라의 법인도 민법상 당사자의 지위를 명문으로 인정하고 있는 것 등을 들 수 있다. 또한 북한 채권법의 변모와 그 특색으로는 담보책임을 보다 구체적으로 규정하는 것, 공민(사인)을 대상으로 하는 보관계약, 빌리기계약, 위임계약에 대하여 당사자의 합의에 의하여 유상이 될 수 있도록 하고 있는 것, 불법행위책임의 내용으로 정신적 손해를 인정하는 것 등을 들 수 있다. 이러한 북한 민법의 최근의 변화된 모습은 그간 남북한 민법 사이의 이질성을 극복하고 그 접근가능성을 높여 주는 것이다.
Abstract
North Korea amended the Civil Law in March 24th 1999 after the amendment of the Constitution in 1998, they established the Law of Compensation in Aug. 22th 2001 and the Civil Proceedings Act had amended three times since in 2002. These situations are a kind of reformation of the Law of Civil Code. In addition to that, maybe we prospect the transformation of the management of the law of property through the arrangement for the improvement of economy administration that was reshuffled by the North Korea July 1st 2002. Especially the transfiguration and the peculiarity of North Korean Civil Law are the establishment of the article for incompetent, the registration to be the requirement for the creating of an artificial person and the recognition of the party’s position of the foreigner’s artificial person On the other hand, the transfiguration and the peculiarity of North Korean the Law of Obligation are the thing that party’s mutual agreement makes the contract counter value in Bailment, Lease and Mandate which object is public person, the recognition of mental damage as unlawful liability.
