About five years passed after the Civil Execution Law had been enacted. This research touches the current state and the view of the Civil Execution Law. Especially, the real estate auction as a civil execution is discussed. First of all, this research analyzes the current state by using the statistical material of the real estate auction. Next, some problems of the present system are pointed out. Afterwards, it proceeds to a discussion by proposing the improvement in the future. The principal object of this research is a point of the problem that obstructs the effect of the real estate auction. It will not persuade the point of the problem to the Civil execution Law of passing a short management period by the result in a simple numerical value so much. However, there is no complete system from the start. Changing into a complete system through the trial and error is usual. This research may be used as material of such an improvement and it will be great.
