기업의 환경규제에 대한 위반요인분석

초록
환경규제가 법에 의한 직접규제방식 보다는 간접규제방식으로 전환하고 있고, 환경문제를 시장의 원리에 맡기고자 하는 방향으로 환경정책이 시행되는 것이 바람직하다면, 이러한 정책적 시행에 앞서 직접규제방식에 의해서 규제를 위반했던 기업들의 특성요인이 무엇인지를 분석해 보는 것이 올바른 방향설정을 위한 초석이 될 것으로 생각된다. 본 연구는 이러한 배경 하에서 환경규제를 위반한 기업들의 특성요인을 분석하고자 하였다. 실증분석결과 첫째, 환경규제 위반성향은 지배주주지분율, 자본집약율, 산업특성과 양의 유의적인 관계를 보였으며, 이에 반해 연구개발투자비율과는 음의 영향관계를 보였다. 둘째, 환경규제 위반빈도는 연구개발투자비율, 수출비율과 음의 유의적인 관계를 보였다. 셋째, 환경규제위반에 대한 처벌정도는 기업특성에 의해 영향을 받지 않음을 알 수 있었다. 이상의 실증분석결과, 환경규제위반은 다양한 기업특성요인에 의해 영향을 받고 있는 것으로 나타났으며, 본 연구의 이러한 실증분결과는 향후 기업 및 정부기관의 환경정책 및 공시정책 결정에 영향을 미칠 것으로 기대된다.
Abstract
Concering the environmental regulations, the direct regulations have been transformed into indirect regulations. If government institutions want to solve environmental issues on market principles, it is important to analyze the factors on regulation violation in corporate before the environmental policy is implemented. Therefore we attempt to find the violation factors on environmental regulation in corporate. From the results of empirical study, first, we found that the propensity of environmental regulation violation was positively associated with control ownership, capital centralization, and industry characteristics. Meanwhile, we found that the propensity of environmental regulation violation was negatively associated with R&D. Second, we found that the frequency of environmental regulation violation was negatively associated with R&D, and export. Third, we found that the degree of executive disposition on environmental regulation violation was not affected by corporate characteristics. We concluded that environmental regulation violation was affected by corporate characteristics, and it varied with corporate characteristics. These findings may prove helpful for corporate and government institution to formulate environmental policies.
