인터넷규제와 청소년보호 - 미국법을 중심으로 -

인터넷은 국민의 기본권인 표현의 자유를 누리도록 하고 많은 정보를 손쉽게 얻을 수 있게 하지만 다른 한편으로는 무차별적인 정보를 제공하기도 한다. 이러한 무차별적인 정보제공의 결과는 청소년들로 하여금 무분별하고도 절제되지 않은 정보에 쉽게 노출되도록 한다. 인터넷상에서 유통되는 음란물로부터 청소년을 보호하기 위한 수많은 노력이 있었다. 그러나 그 결과는 미약하다. 세계 각국에서 수년 동안 인터넷상에서 유통되는 법령이 제안, 통과되었으며 법정에서 다루어지고 논쟁의 대상이 되어왔다. 인터넷상에 노골적인 性的 정보는 헤아릴 수 없을 만큼 증가하고 있다. 또한 컴퓨터가 대중화 되면서 컴퓨터를 사용하는 청소년들의 연령은 나날이 어려지고 있다. 미국은 일찍이 이러한 문제점을 인식하고 1996년 통신품위법을 제정하였지만 그 규정의 모호성으로 인하여 위헌판결을 받게 되고, 이어 제정된 어린이온라인보호법마저 위헌판결을 받게 된다. 청소년의 보호만을 목적으로 하였지 인터넷의 특성을 반영하지 못한 광범위한 자유의 제한이 성인이나 다른 국민의 자유를 제한하기 때문이었다. 그러나 미국에서의 인터넷상의 정보로부터 청소년을 보호하기 위한 노력은 지속되고 있다. 우리나라에서도 청소년위원회가 설립되어 청소년보호를 위한 노력을 하고 있다. 다만 청소년보호법만으로는 현재의 인터넷을 통한 정보유통으로부터 청소년을 보호하기 위한 방법을 제시하기에는 부족할 수 있다.
Abstract
The Internet enables people to have unlimited access to the huge amount of information while providing the rights of free speech. With the emergence of the internet, the youth are easily exposed to the indecent and unwanted material on the internet. A great deal of efforts has been made to protect the youth from internet pornography but seem to get no closer to the goal. Legislators, policy-makers, administrators and the judiciaries have begun to address the issues on the internet communication for more than a decade. As internet pornography has been disseminated at an ever more alarming rate, younger and younger children learn to use the computer and to access the internet, that accelerates the probability of exposure to the internet pornography for the teen-age users of the internet. In order to restrict minors' access to indecent content on the internet, the U.S. Congress enacted the CDA of 1996, but the U.S. Supreme Court rejected the CDA because the provisions of the CDA effectively suppresses a large amount of speech that adults have a constitutional right to receive and to address to one another. After the Court's rejection of the CDA, COPA was enacted and was invalidated due to focusing mainly to protect the youth and then did limit the freedom of people. However, the struggle to save the minors from Internet pornography has been made in the U.S. The Korean Government Youth Commission is established to protect the youth in various ways. Youth Protection Act is available to deny the youth access to potentially harmful contents on the Internet, but is not sufficient for the protection of the youth from the Internet assault. Legislation for the youth protection from the indecent material on the Internet is needed.
