영국 자산회수국의 조직과 역할에 관한 연구

초록
추징금의 경우 최근 고액 추징금 미납자의 증가로 추징금 미납율이 1999년에 들어서면서 거의 97-99%를 상회하고 있어 형벌로서의 기능을 사실상 상실했다고 보아도 과언이 아니다. 2006년을 기준으로 추징 대상액 24조 6376억 중에서 185억만이 집행되었기 때문이다. 그런데 이처럼 형집행이 확보되지 않고 집행되지도 않는다면, 수사와 재판 그 자체는 의미를 상실하여 존재가치가 없다고 볼 수 있다. 왜냐하면 형벌이 집행되지 않는다면 수사와 재판은 목적달성 불능을 위한 인력과 물자, 시간낭비의 헤아릴 수 없는 무익한 수고의 반복에 불과한 것이며, 결국은 형사사법 운영의 기본적 틀이 무너지게 되는 파국적 상태가 초래될 수 있기 때문이다. 따라서 재판의 결과인 형벌의 철저한 집행이야말로 국가 형사사법 작용의 무력화를 방지할 수 있는 유일한 길이라고 할 수 있다. 그런데 이처럼 몰수ㆍ추징의 운영 상황에 문제가 많음에도 불구하고 그동안 형벌론의 관심사는 주로 자유형 등 주형(主刑)에 집중되어 왔고, 이에 따라 몰수ㆍ추징에 대한 관심은 상대적으로 미미하였다. 그러나 몰수ㆍ추징이 실제 형사사법에서 차지하는 비중을 무시할 수 없고, 근자에 들어와서는 범죄에 대한 대체적(代替的) 통제수단으로 몰수(추징)에 대한 관심이 고조되고 있으며, 나아가 조직범죄ㆍ마약범죄 등을 중심으로 국제적인 공조도 추진되고 있다. 따라서 본 논문에서는 몰수(추징)를 전담하는 영국의 자산회수국의 조직과 역할을 검토함으로써 우리나라에서도 바람직한 몰수 내지 추징을 위한 기구의 설립을 제안하고자 한다.
Abstract
The purpose of this study is to examine the setup and function of the Assets Recovery agency(ARA) of the England. In England, the creation of the standing ARA heralds significant changes in the detection, investigation and prosecution of crime and the confiscation of property derived from crime. The ARA has three distinct operational functions: criminal confiscation, civil recovery, and the taxation of income related to crime. To realize this three distinct operational functions, the ARA has three strategic aims: 1. to disrupt organised criminal enterprises through the recovery of criminal assets, thereby alleviating the effects of crime on communities; 2. to promote the use of financial investigation, within and outside the Agency, domestically and internationally, through training and continuing professional development; and 3. to operate the agency in accordance with its vision and values. For the effective role of Assets-Recovery in Korea. It needs to be bench-making the setup and function of the ARA of the England, because the Government is responsible for ensuring that procedural rules are observed from the investigation to trial enforcement.
