조망권에서 바라본 경관법의 법적 검토

It is no wonder that People want to live at the comfortable surroundings. The prospect right has an effect on a real price of a dwelling house, with the consequence that the disputes related to the prospect right, the most recent, are increasing gradually. A safeguard of the prospect right is acknowledged when the Property connected with it is violation of another´s rights by a adjoining landowner. A few theories has tried to justify the grounds for recognition of the prospect right. There are the real property, personal right, environmental right, etc. For the present, the Supreme Court get a knowledge of the necessity of the protection of the prospect right and have recognized it in some conditions. For frustrating such a problem by a legal system, the Landscape Law is established in the year 2007. In this thesis, I investigate the relation between the prospect right and the Landscape Law. Specially, the Landscape agreement, which make a contract in a landowners etc, is of importance. But it contains a many legal disputes. The Supreme Court establish a new precedent, but contains the same problems.
