교화와 응보개념을 통한 행형목적 이해에 대한 연구

본 논문은 행형(行刑)이 ‘교화(敎化)와 응보(應報)’라는 공존할 수 없을 것 같은 목적들로 기술되어질 때, 이를 어떻게 이해하고 해석해야 하는지에 대해 설명하였다. 행형목적갈등에 대한 해결을 모색하기 위해서 본고에서는 보드리야르(J. Badrillard)의 시뮬라시옹이론 및 하이데거(M. Heidegger)의 존재론적 사유를 활용하였다. 특히, 보드리야르의 시뮬라시옹 이론을 통해 행형목적인 교화나 응보 자체가 하나의 시뮬라크르일 수 있고, 그 내면에는 다른 목적도 잠재해 있다는 것을 알 수 있었다. 그리고 이러한 과정(過程, process) 속에서 하나의 시뮬라크르로서 교정(矯正)의 다양한 의미를 확인해 볼 수 있었다. 아울러 이러한 이론적 접근을 활용하여, 갈등관계의 행형목적의 해소를 위한 대안을 찾아보았다. 특히 ‘현실의 장(場)’에서 발생하는 사례들을 통해 행형개념의 갈등요소들을 해소하는 방안으로 몇 가지 단서(端緖)들을 제시하였다. 이것은 2가지 관점 중 한 가지를 선택하거나 둘 사이의 중간점을 찾자는 선형적인 절충이 아닌, 지평(dimension)을 다르게 볼 수 있는 관점에 관한 것이다. 그 관점들로서 행형목적에 대한 이중성(二重性, duplicity)의 이해, 동사적 개념으로의 전환, 현실의 한계인식을 언급하였다.
Abstract
The purpose of this paper is to explain how penology, which includes two incompatible elements "correction or resocialization" and "retribution," should be understood and interpreted. In order to understand these seemingly dualistic objectives as duplicity in a higher dimension, I consider different viewpoints of penology in actuality and suggest several solutions to discord that comes from the difference. As tools for discussion, I used Baudrillard's simulation theory as a theoretical framework to understand penology in actuality, and employed M. Heidegger's thinking of The Being to derive the solutions. This paper consists of four chapters. Chapter I provides the problem discussed in the paper and a foundation for its solutions. In Chapter II, using Baudrillard's simulation theory, I describe that correction or retribution itself can be a simulacre, and that control by power can lie behind them. In other words, it is shown that the process of simulation conceals the original of the simulacre, that is, the deep image that is not seen. The above explanation, however, is useful only for approach to penology from the theoretical view, so penology in actuality is discussed in the next chapter. In chapter III, I examine through specific examples how the objectives of penology discord in the field of actuality, and suggest a solution to that disagreement. Instead of taking a linear compromise by adopting one of the two objectives or by searching a middle point between them (to change the way of thinking), a new approach to the problem in a different dimension (a turning the site of thinking) is suggested as the solution. That approach includes three points : Understanding of the duplicity of the purpose of penology, conversion to the verbal concept and cognition of the limit in actuality. Finally, Chapter Ⅳ summarized the paper. This paper especially emphasizes that understanding of the accurate meaning of actuality should come first for improvement of penology, because setting an ideal without the exact recognition of the current state only leads to a dissonance. In order to resolve the estrangement between the actuality and the ideal, a more serious self-examination is needed and should be continued.
