송이採取에 관한 山林契의 慣習

This article is the report of the custom of the forest-union about the pine mushrooms collection. The Korean Civil Law Article 302 stipulated in a case where the inhabitants of a certain area, as a collective body, are entitled to take grass or trees, catch wild animals, take earth or sand, rear live stock, or take other profits from the land of the area owned by another person, the provisions of this Chapter shall apply mutatis mutandis subject to the custom of each locality. I report that confirmed the present of the custom of the pine mushroom collection by the Special Servitude of the Korean Civil Law or one of the property right in custom. This article consider a question in legal aspects of the system and organization of the forest-union(Sanlimgae) under the custom research in 2002 and 2003 at Ulgin county and Youngduk county of Kyungbuk Province. I think that the custom of the collection of the pine mushrooms trace the origin of the firewood and pasture system(Sichojang) of Yi dynasty and right of common under the Japanese imperialism. In present, the custom of the collection of the pine mushrooms is alive living written system and it operate by the forest-union de facto. The forest-union received benefits by the collecting mushroom, the member of forest-union is distributed profit sharing. Hereafter this study as investigation of custom continues by the subsequent generation.
