슬링박스의 place-shifting에 대한 법적 규율 －전기통신기본법과 지적재산권의 관점에서-

인터넷을 통해 TV 등의 동영상을 송출해서 전 세계 어디에서든지 유무선 인터넷에 접속하여 수신시청할 수 있게 하는 슬링박스는 place-shifting을 위한 장치이다. 이는 일종의 ‘개인 IP-TV중계장치’이다. 우리 법규에 따르면 슬링박스의 송출은 공중을 상대로 하는 것이 아니므로 방송이 아닌 전기통신에 해당된다. 또한 슬링박스 자체는 전기통신기본법상 자가전기통신설비이므로, 방송통신위원회에 설치신고할 의무와 사용전 확인의무가 부과된다. 이를 위반할 경우 1년 이하의 징역이나 1천만원 이하의 벌금에 처하게 된다. 이 규정은 대규모의 자가전기통신설비를 예상하고 만든 규정이므로 슬링박스와 같은 가전제품수준의 개인장비에는 적합하지 않은 것이다. 새로운 기술발전에 의해 불합리하게 된 법적 규제는 이제 개정되어야 할 것이다. 슬링박스는 1개의 장치에만 송출하도록 기술적 조치가 포함되어 있으므로 저작권법상의 문제를 발생시키지는 않는다. 그러나 그것을 우회하는 무력화도 예상되므로 향후 저작권침해의 문제도 예견된다. 기술진보는 고성능화, 소규모화, 개인화의 방향성을 갖는다. 슬링박스 역시 이러한 방향성을 따르고 있는 것이다. 기술진보로 인해 발생하는 기술과 법의 갈등은 쉽게 해결될 문제는 아니다. 전통적인 개념법학적인 규율보다는 기능을 기준으로 하는 기능법학적인 규율로 법학의 진보도 이루어져야 할 것이다.
Abstract
The ‘Slingbox’ that a user install in his home and then with which a user can enjoy the TV program etc. by access to internet around the world. It is a home appliances for place-shifting and a kind of ‘personal IP-TV sending device’. Under the current law sending a TV program by Slingbox is not broadcasting but telecommunication for its per- sonality. Because the Singbox is ‘individual telecommunication facilities’ under the Tele- communication Act, a user burdens the duties to make a report for installation and to verify it before operation. If a user will break the duties, he is punished with under 1 year in prison or a fine under 10 million won. For this regulation is provided assuming magnificent individual telecommunication facilities for a large enterprise, it is not appropriate to the Slingbox as a home appliance. It has to revised for new technology. The Slingbox contains a technical measure to send TV program to just only one device so that it obeys copyright act. However if a user will incapacitate the measure for protecting copyright, a regal con- troversy may be raised. The innovations in technique have a trend of high effectiveness, downsizing and indi- viduality. Slingbox follows this trends. The conflict between law and technology for inno- vation is not solved easily. The function-oriented legal approach may be a one of the solutions.
