성서와 찬송가를 둘러싼 저작권쟁점 연구

The book market of the Holy Bible and the Hymn has grown up tremendously as the number of christians increased rapidly in the last one and half centuries. The Holy Bible translated into Korean, whose orignal versions are in Hebrew, Aramaic, and Greek, is regarded as a kind of derivative works in copyright law. There are several copyright court cases related to revising versions of the Holy Bible in Korea. The Hymn is a kind of compilation works composed of more than 500 songs that are selected or arranged in such a way that the resulting work as a whole constitutes an original work of authorship. Copyright disputes has occurred between copyright agency and Korean Hymn Society for the last few years. It is problematic that we can hardly find discussions regarding copyright issues of the Holy Bible and the Hymn. This article is going to analyze the court cases in Korea related to the Holy Bible, and find available defenses and harmonious solutions between copyright protection and fair use in religious works.
