초록
국가보안법은 적어도 표면적으로는 국가보안의 중심축이었지만, 그것은 동시에 인권 침해 법률의 대명사이다. 미국의 국가보안법제의 경우 전시 및 냉전체제 하에서 잠시 등장했다가 곧 사라졌음에도 불구하고 그 잔영이 오늘날 한국에는 여전히 남아 있다. 이 논문은 9․11 이전의 20세기 전반에 한정하여 미국의 국가보안법제의 형성과 전개 과정을 고찰함으로써 한국의 국가보안법을 평가함에 있어서 일정한 헌법적 시사점을 얻고자 하였다. 첫째, 미국의 국가보안법제는 양차 세계대전 그리고 동서냉전체제와 같은 전시 혹은 이데올로기 대립 상황의 산물임을 확인할 수 있었다. 둘째, 그러나 전시 상황의 종료 또는 국내 정치체제의 안정과 더불어 민주주의 입헌국가 체제의 공고화를 거치면서 그러한 비상적 국가보안법제는 소멸되었는데, 특히 법원은 그 과정에서 위헌판결을 통해 큰 역할을 하였다. 셋째, 그럼에도 불구하고 대한민국의 입법과 판례는 국가보안법제와 관련하여 과거 냉전체제에서의 입법과 판례로부터 벗어나지 못한 채 단지 분단과 북한의 존재 자체로부터 헌법이 보장하는 국민의 사상․이념․표현의 자유를 지나치게 제한하는 국가보안법의 합헌성을 도출하는 구시대적 논리를 되풀이하고 있다고 평가할 수 있다.
Abstract
I made a comparative study of the legal mechanisms for national security in USA. As a result, I came to a conclusion as below. Firstly, the national security laws(NSLs) were enacted under the emergency circumstances of the wartime or the ideological conflicts, for example, in/ after the World Wars or in the cold war order between the east and the west countries. After the end of the emergency circumstances or the stabilization of democratic constitutionalism by the settlement of the political system, the legislature or the judicature abolished the NSLs. Secondly, the NSLs were confronted with a campaign against their enactment. And the Federal Supreme Court reinforced not the legal system for national security but the guarantee of human rights. Finally, although the USA abolished the NSLs scores of years ago, the legislature and the judicature of ROK have not nevertheless abolished the Korean NSL. They have found their reasons in the existence of the Democratic People´s Republic of Korea by the division of the Korean Peninsula and have supported the NSL of ROK that has infringed the human rights, such as the liberty of thoughts, ideology and expression.
