WTO 가입에 따른 중국부동산법제의 변화와 문제점 분석

The country has revised the real estate-related laws and regulations including the law of realty, and stipulated for automatic renewal after the termination of a term on housing construction sites, It has also made improvement so that land concession under the free distribution system is traded for compensation under the open price system and made room for arrangement of market policy for farming land. China has also introduced the real estate administration system that is more commonly used on a global level such as real estate price evaluation system. There still remains the problems of the government's excessive intervention, mutual conflict between overlapping, multidimensional legislations that are centered on subordinate laws. In future, in order to overcome conflict arising from the disparity between the WTO system and current legislative system, China is expected to continue its improvement across the real estate legislative system, and institute a systematic and technical 'real estate basic law,' upon the legal foundation of realty, real estate administration, and urban real estate administration.
