금강산관광객 피격사건으로 인한 분쟁의 해결 방안 및 관광재개에 관한 법적 검토

초록
북한은 금강산관광객인 민간인을 경계철책을 넘어왔다는 단순한 이유로 총격사망하게 하고 이에 대한 진상조사 및 피해보상 등을 거부하고 있다. 또한 이를 이유로 민족화해의 상징으로 자리잡은 금강산관광을 무기한 중단시키고 있다. 북한은 남북공동위원회를 구성하고 정확한 진상조사에 임해야 할 것이며, 관련자처벌 및 피해보상 등 재발방지대책을 서둘러야 할 것이다. 다만 현재의 남북관계가 정치적인 사안과 맞물려 우려되는 경색국면을 맞이하고 있으므로 민간차원의 분쟁해결기구인 남북상사분쟁위원회에 의하여 피해자보상 등의 문제에 관하여 논의하도록 하는 방안을 강구하여 볼 필요가 있다. 한편 금강산관광은 남북화해 및 장래에 있을 민족통일의 초석으로서 가까운 장래에 재개되어야 하고 또한 발전하여야 할 것이다. 이를 위하여 남북한의 정치적인 상황변화에 영향을 받지 않고 관광사업을 추진할 수 있는 독립적이고 중립적인 금강산지구 관리기관을 설립하여야 한다. 또한 금강산지구가 지금보다 더 발전된 복합관광단지로 성장하기 위해서는 외국인투자유인책을 확대하여야 할 것이다. 토지이용료도 보다 저렴한 수준으로 책정하여야 할 것이며, 남한동포투자보호법(가칭)을 제정하여야 할 것이다. 또한 노동유연성을 확대하기 위하여 고용과 해고의 자유를 보장하는 노동계약제를 실현하여야 할 것이다.
Abstract
North Korea has shot a tourist to death for an unjustifiable reason that the tourist has broken through the borderline. Moreover North Korea has rejected joint investigation of the accident and compensation for the damage required by South Korea, whereby the sightseeing in Keumkangsan area has been suspended without time limit. North Korea should accept the demand of South Korea that Joint Committee should be formulated and exact situation of the accident be investigated, whereby the person occurring the accident should be punished and the damage be appropriately compensated. At this stage in order to ease the tension, the disputes could be settled through the Commercial Arbitration Committee formulated by South and North Korea. In the other hand the sightseeing in Keumkangsan area shoule be reopened and developed in near future for the peaceful atmosphere and reunification of korean peninsular. In this connection independent administrative organization should be formulated, whereby stable and persistent tour business in those area could be made. Furthermore for the purpose of much foreign capital being invested in the area and gross development similar to Hong Kong or Las Vegas, low level of tax or real estate and liberal employment of labors should be ensured.
