검사작성 피의자신문조서와 영상녹화물의 증거능력

Admissibility of Prosecutors' Interrogation Dossiers and Interrogation Videotape in the New Criminal Procedure Code

2007년 4월 30일 형사소송법이 전면적으로 개정되었다. 사법개혁위원회와 사법개혁추진위원회 내부의 격렬한 논쟁을 거쳐 1954년 형사소송법 제정 이래 유지되어 온 형사소송법의 골간이 바뀐 것이다. 특히 그 과정에서 검사작성 피의자신문조서와 영상녹화물의 증거능력이 논쟁의 초점이 되었다. 이 사안 이외에는 비교적 원활한 타협이 이루어졌지만, 이 사안에 대해서만은 양보 없는 ‘전쟁’이 벌어졌다. 결과적으로 상처는 입었지만 검찰작성 피의자신문조서 자체는 생환하였다. 그리고 영상녹화물에 보충적 증거능력을 부여한 사개추위안은 국회에서 삭제되었다. 개정과정에서 드러난 시각 차이는 개정 형사증거법의 해석론으로 이어지고 있다. 필자는 개정 형사소송법이 조서의 진정성립을 인정하는 새로운 방법을 추가하였지만, 진정성립 인정을 위해 사용될 수 있는 방법은 영상녹화물에 준하는 “객관적인 방법”이어야 하므로, 조사자, 조사과정에 참여하여 조사사실을 들은 사인, 속기사 등의 증언 등은 이에 속할 수 없다고 해석한다. 필자는 조서를 둘러싼 첨예한 입장 차이를 절충해야 했던 입법부의 선택을 존중하지만, “변호인의 참여 등”이라는 특신상태의 예시규정이 삭제된 것에 대해서는 비판적 시각을 견지하며 현재 특신상태라는 문언은 명확성의 원칙에 반하는 위헌소지가 있다고 판단한다. 한편 피의자진술이 기록된 영상녹화물의 증거능력은 법 개정안 제안서와 입법과정에서 확인된 것처럼, 조서와 무관하게 본증으로 인정하거나 기억환기용 이외의 탄핵증거로 사용하는 것을 허용할 수없다고 해석한다. 그리고 피의자의 동의 없이도 영상녹화가 가능하도록 한 것은 진술거부권을 침해할 소지가 있다고 판단한다.

Abstract

The Article 312 of the Criminal Procedure Code has given an exceptionally strong evidentiary power to prosecutors' interrogation dossiers even if they are hearsay. It was criticized because it makes extremely difficult for the defendants to escape from a guilty judgement in a trial once they have made self-incriminating statements in front of prosecutors: the Article makes prosecutors de facto judges. On December 15, 2004, the Presidential Committee on the Judicial Reform was established to revise the Criminal Procedure Code. The Committee attempted to prohibit prosecutors' interrogation dossiers from being admissible in a trial unless the defendants agree on the use of them. However, prosecutors strongly objected to the Committee's project. The heated debate over the revision of the Code ended in a compromised way. In the 2007 revision of the Code, the National Assembly decided to maintain the evidentiary power of the interrogation dossiers but imposes stricter requirements. The new Criminal Procedure Code still fails to overcome the phenomenon of "trial by dossiers" that truth-finding heavily depends on the interrogation dossiers submitted by parties, not on the cross-examinations by the parties in a courtroom. Prosecutors will keep making efforts to include self-incriminating statements of the suspects in their interrogation dossiers and will argue that the dossiers should be admissible without cross-examination in the court even if they have been made without the presence of the defense attorney. It is also necessary to note that the requirement of "special circumstances which make the dossiers reliable", which allows the dossiers to be admissible without cross-examination in a trial, is very vague, so may invite constitutional challenge. On the other hand, prosecutors' request to stipulate a provision regarding the evidential power of the videotapes recorded during interrogation was not accepted by the National Assembly. The videotapes may be used only "when it is necessary to refresh the memory of a suspect or a witness" in a trial under the new Criminal Procedure Code. The original draft of the Presidential Committee required the consent of the suspects or their attorneys for the videotape recording, but the requirement was removed by the National Assembly. Even with suspects' objection, accordingly, the investigative authorities may record interrogation, so there is concern that the right to silence may be weakened.
