남북한 헌법체제의 비교와 통일헌법의 지향점 및 과제

초록
올 해는 대한민국 정부수립 60주년을 맞는 뜻깊은 해이다. 앞으로 통일국가 건설이란 국가적·민족적 목표를 향해 매진해야 할 역사적 과제가 우리 앞에 놓여 있다. 그런 의미에서 올 해는 새로운 통일의 역사를 만들어 나가는 새 출발의 해가 되어야 할 것이다. 이와 관련하여 우리가 ‘준비된 통일’을 이루기 위해서는 통일국가의 미래상을 상정하고 통일헌법에 관한 논의를 전개할 필요가 있다. 여기서는 우리 역대 정부의 통일방안 중 합리적이고 체계화된 통일방안으로서 국민적 공감대가 형성되어 있다고 볼 수 있는 ‘민족공동체통일방안’ 에 입각하여, 우리가 지향하는 통일헌법의 최고원리와 제정방향, 기본질서에 관하여 총론적으로 간략하게 살펴보았다. 오늘날 인간의 존엄과 가치존중은 현대 민주국가에서 가치적 공감대를 이루며, 따라서 이를 헌법의 이념적 기초로 삼고 있다. 통일헌법에 있어서도 최고의 가치는 인간의 존엄과 가치의 존중에 두어야 한다. 이는 우리의 「민족공동체 통일방안」에서 제시하고 있는 ‘자유·복지·인간존엄성이 보장되는 선진민주국가’라는 통일국가의 미래상과 관련하여 볼 때도 합당한 이념과 가치인 것이다. 통일헌법은 인류문명의 기준에 입각한 보편성에 합치되어야 한다는 점에서도 인간의 존엄과 가치존중의 이념은 통일헌법의 최고원리가 되어야 할 것이다. 우리의 「민족공동체 통일방안」은 통일국가의 미래상으로 남북한의 민족구성원이 모두 주인이 되며, 민족구성원 개개인의 ‘자유’와 ‘복지’와 ‘인간존엄성’이 보장되는 선진민주국가를 제시하였다. 그런 의미에서 통일국가의 미래상은 ‘자유와 평등이 조화되는 민주복지국가’로 상정할 수 있다. 따라서 우리가 먼저 생각할 수 있는 통일헌법의 체제도 이러한 통일국가의 미래상을 구현할 수 있는 것이어야 한다. 통일헌법의 기본질서는 통일국가의 미래체제로서 상정한 기본이념에 상응하여 설정되어야 한다. 여기서는 통일국가의 미래상으로서 ‘자유와 평등이 조화되는 민주복지국가’의 건설을 상정하고 통일헌법의 제정방향을 고려하여 정치적·경제적·사회문화적인 면과 국제적인 면에서의 기본질서에 관하여 고찰해보았다.
Abstract
This year is meaningful for the 60th anniversary of the Government of the Republic of Korea, that is the time that we confront with a historical task to which we should direct to attain national and state goal. And this year shall be a new commencement for the South Korean making a new history of Korean peninsula reunification. At present, we are required to set up a future vision of the unified Korea and to deploy discussions on a unified constitution in order to come true "Prepared Unification of South and North Koreas". In this study, utmost principles, establishing directions and basic orders of the unified constitution being directed by the Koreans were generally analyzed from the stand point of "The Korean National Community Unification Formula" which is the most reasonable and systemized among Unification plans of the past South Korean Regimes and has equipped with a national positive response. In modern times, human dignity and worth respect have firmly equipped with positive value response in democratic countries so that the two basic mottos have been the ideological basis of modern constitutions. Therefore, the utmost value will be placed on human dignity and worth respect in the unified constitution as well, that are also quite reasonable ideology and value in respect to future vision of unified country "Advanced Democratic Country" where "freedom, welfare, and human dignity being suggested by "The Korean National Community Unification Formula" are secured. And also the ideology of human dignity and worth respect should be the utmost principle in the unified constitution regarding the viewpoint that the unified constitution should conform with the universality of mankind civilizations as well. “The Korean National Community Unification Formula” is a future vision of the unified country where all of the Korean nationals will become masters of the unified country that is suggesting an advanced democratic country where freedom, welfare, and human dignity of all Korean nationals are guaranteed. On this meaning, a future vision of the unified country can be imaged by a democratic welfare state where freedom and equality will be harmonized each other. Therefore, a unified constitutional system that may be designed by us should be the one that can realize such future vision of the unified country. Basic orders of the unified constitution shall be set up in conformity with the basic ideology that has been set up under the future system of the unified country. In this study political, economical, socio-cultural, and international aspects of the basic orders were analyzed by assuming a construction of a democratic welfare state where freedom and equality will be harmonized each other, as a future image of our unified country, and by considering the established direction of the unified constitution.
