미국저작권법상 공정사용의 법리 : 패러디에 관한 논의를 중심으로

초록
오늘날, 저작권침해사례가 점차 증가하고 있다. 미국 의회는 최초로 책과 지도만을 저작권으로 보호했으나 점차 미술, 기술 등의 영역으로 확장되었다. 사람들은 책, 라디오, TV 등을 통해 다양한 패러디를 접하고 있다. 패러디는 오늘날 중요한 창작물로서 문화의 발전에 기여하고 비평적 기능을 수행하나 원저작권자의 이익을 해하므로 저작권자와 패러디작가들 사이의 적절한 이익균형이 필요하다. 즉 패러디가 원저작자의 동의를 얻지 못하더라도 미국 저작권법상의 공정사용에 해당한다면 패러디를 보호할 필요가 있다. 미국의 연방대법원은 Campbell 사건에서 공정사용 여부를 판단함에 있어 획일적으로 판단할 것이 아니라 사안별로 구체적으로 판단해야 한다고 하여 패러디저작자와 원저작권자 사이의 적절한 이익균형을 도모하고 있다. 한편, 미국의 연방대법원은 Eldred사건에서 수정헌법 제1조가 공정사용 법리에 영향을 미치도록 판시하여 표현의 자유를 신장하기 위해 기존의 판례와 다른 새로운 해석을 시도하고 있다. 우리 저작권법은 미국의 공정사용에 해당하는 일반원칙 규정을 갖고 있지 않고 저작권 침해로부터 저작권을 보호하기 위한 개별적, 구체적 규정을 갖고 있다. 그러나 표현의 자유를 신장하고 정보를 널리 공유하기 위해서는 미국 저작권법상의 공정사용에 관한 일반원칙 규정을 두는 것이 바람직하다고 할 것이다. 그러나 해석상으로도 최근 우리 하급심이 패러디가 원저작권을 침해하는지 여부를 판단함에 있어 미국의 공정사용 법리에 해당하는 4가지 표준에 유사한 기준을 적용한 점과 우리 저작권법 제28조와 제1조를 종합하면, 우리 저작권법도 공정사용에 관한 일반원칙규정을 도입한 것으로 해석할 수 있을 것이다.
Abstract
Nowadays, the number of infringement cases in the copyright area is increasing. In the United States of America, Congress initially protected only books and maps. With time, however, the law expanded to include new forms of art and technology. Most people are confronted with numerous parodies in the entertainment industry via books, the radio and television. Therefore, a parody is a significant creative medium in our contemporary. Aparody not only has entertainment value, but also serves a critical function. Protection of parodies is one of society’s values. However, it is against the interest of the author of creative works. If society allows the free creation of parodies, copyright holders will lose their interests. Therefore, a solution will balance the interests of the copyright holder and the parodist. To analyze the fair use doctrine in a parody and look at the balance between the copyright holder and the parodist, it is valuable to consider the case of Acuff-Rose Music, Inc. v. Campbellbecause it gave an important precedent for us to decide and use the fair use doctrine. In Campbell, the Court stated that one should judge fair use on a case-by-case basis, in other words, by all four fair use factors. In the case of Eldred v. Ashcrofit which is the most recent conclusive statement on the relationship between copyright and the First Amendment, it gives us a number of ways that the First Amendment could be brought to bear to revive the fair use doctrine for free speech and expression. In Korea, there is currently no general clause like the fair use doctrine in the United States. The Copyright Law of Korea provides individuality when the law needs to protect the infringers from copyright holders. However, to develop free expression and to encourage the sharing of information, it is important to introduce a general clause to protect parodies in Korea. Recently, the Seoul Central District Court noted that 4 points need to be considered when determining whether a parody infringes the copyright holder. They did this by interpreting Article 28 of the Copyright Act which is about the standard of citation use. In it, Article 1 is about the balance of interests of the copyright holders and users, while Article 28 is about citation in the Copyright Act of Korea. It is therefore possible to use the fair use doctrine, so that it has the same effect as the general clause in the United States of America.
