고대 메소포타미아의 수메르 우르-남무 법의도덕성에 관한 연구

초록
우르-남무(Ur-Nammu)법은 고대 메소포타미아(Mesopotamia)의 수메르어로 기록된 최초의 법으로 알려져 있다. 이 법은 기원전 2100년경 우르 제3왕조의 창건자 우르-남무나 그의 아들 술기 왕에 의해 만들어진 것으로 알려져 있다. 전문과 약 37개의 조문으로 되어 있지만 결어 부분은 결여되어 있다. 고대 메소포타미아의 보편적인 결의법 형식으로 주어졌으며 왕은 전문에서 왕권신수설과 수메르와 아카드의 백성들을 해방시켰다고 주장한다. 이 법에서 종교와 도덕은 밀접에게 연결되어 있다. 사형이나 동해보복형을 제한하고 금전적 보상을 하도록 했다. 결혼, 이혼과 합의 등 특히 가정의 충실성을 지키고자 하는 것은 개인의 복리뿐만 아니라 사회의 도덕성을 신장하는데 근본적인 것으로 보인다. 신체 상해에 대한 다양한 법규정 등은 몸을 건강하게 보존하는 것의 동양적 개념과 조화된다. 약자와 가난한 자들에 대한 배려는 모든 인간 역사에서 도덕성의 기초이다. 우르-남무는 도량형을 처음으로 통일시켰는데, 이것이 사회 안정과 경제 정의의 기본이다. 이동의 자유를 보장하는 입법은 인권을 위한 귀한 규정이며, 재산권은 후대의 입법 전승에서 추구된 가치이며, 특히 주인의 재산으로 인정되었던 노예제도는 거의 4000여년 후에 극복될 정도의 매우 비도덕적 관행이었다. 사법 과정의 정의는 사회와 백성들의 도덕성을 보장하는 조치이다. 우르-남무 법은 고대 메소포타미아에서 관료개혁, 세금개혁 및 노예해방 등의 법과 정의의 제도인 미샤룸의 조치들을 다룬다. 우르-남무 법은 고대 메소포타미아에서 사회정의 구현을 위한 최초의 입법 조치로서 메소포타미아의 후대 입법 전승의 모델이다.
Abstract
Sumerian Laws of Ur-Nammu is written by Ur-Nammu(c. 2112~ 2095 BC), the founder of Ur III or his son Shulgi(c. 2094~2047 BC). They are written in casuistic form and aim for social justice. Religion and morality is intertwined in the Laws of Ur-Nammu. The law collections are moral in their civility to limit capital punishment and replace it with monetary compensation in stead of death or talionic punishment in the ancient world. Their emphasis on family matters such as marriage, divorce and settlement, especially on fidelity of couples seems to be essential to social morality as well as individual welfare. Their legalization on various physical injuries is in accord with Asian mode of physical ethics, in which keeping the body and its members in healthy state is the beginning of filial piety. As care for the weak and the poor has been the foundation of morality in all human history, Ur-Nammu's Laws claims special care for the poor. He introduced the first standardization of weights and measures, which is vital to social stability and economic justice. The law of freedom of movement is remarkable for human rights. Property rights have been emulated by all succeeding legal traditions, though slavery as personal property is very inhumane to be overcome only after about four millenniums. Justice in legal procedures guarantees the morality of society and people. The Laws show ample elements of misharum, which may be a basis of Mesopotamian morality in the ancient world, entailing reform of bureaucratic machinery, remission of debts and taxes, manumission of slaves and release of land. The laws have became a prototype of Mesopotamian legal tradition. They are torch light for social justice, glimpse of hope for the suffering humanity in the Ancient Near East. They are the first legal collections to be a model of legal tradition in Mesopotamia.
