수산․어업 및 해양환경 분야의 특별사법경찰 직무범위에 대한 고찰

초록
특별사법경찰은 특수한 분야의 범죄에 대한 수사를 담당하는 사법경찰로서, 일반사법경찰이 모든 범죄에 대하여 수사권을 가지고 있는 것과 달리, 일정한 범죄에 대해서만 이를 가지고 있다. 특별사법경찰은 삼림․해사․전매․세무․군수사기관․기타 특별한 사항에 관하여 사법경찰관리의 직무를 행하며, 그 직무의 범위는 ‘사법경찰관리의 직무를 행할 자와 그 직무범위에 관한 법률’ 등에 규정되어 있다. 이러한 특별사법경찰은 일반사법경찰의 수사관할을 일부 분담함으로써 그들의 업무 부담을 덜어줄 수 있다는 장점이 있다. 특별사법경찰이 담당하는 수사에는 관련 전문용어와 그 명확한 기준, 그리고 관련 실무와 정보 등에 대한 행정적 업무능력과 지식이 요구되므로, 이를 일반사법경찰 등으로 하여금 수사하게 하는 것보다는 이 방면에 정통한 수사관으로 하여금 직접 이를 맡게 하는 것이 수사의 전문성과 그로 인한 효율성을 기하는 데에 효과적이라고 할 수 있을 것이다. 우리나라의 특별사법경찰은, 특별사법경찰제도의 취지나 원칙 등이 상당 부분 무시된 채, 주로 관련 부처간 이기주의와 단속의 편의성 및 효율성 등에 근거하여 소관 업무 관련 범죄에 대한 수사권을 요구하고 있을 뿐, 이미 부여된 특별사법경찰권에 대한 합리성, 축소 및 폐지 등과 관련된 논의는 거의 이루어진 적이 없이, 지속적으로 증가해오기만 하였다. 그러나 이미 부여된 사법경찰권이라 하더라도 그것이 원칙과 취지에 위배되고 갖가지 불합리한 점이 있다면 권한의 축소, 폐지, 변경 등의 여러 가지 개선방안을 함께 고려해보아야 할 것이다. 그에 반해 현재 사법경찰권이 부여되어 있지는 않지만 수사의 전문성 혹은 긴급성의 취지 등에 비추어 관련 범죄에 효과적으로 대응할 수 있도록 새로이 사법경찰권을 부여할 필요성이 있는 경우도 있기 때문에 이에 대한 검토도 있어야 할 것이다. 여기서는 이와 같이 방대한 특별사법경찰 중에서 수산․어업 및 해양환경 분야의 특별사법경찰에 초점을 맞추어 특별사법경찰권 부여의 제도적 취지 및 원칙, 직무범위 등에 대해 살펴보았다.
Abstract
Special judicial police is a type of judicial police in charge of investigating crimes of special kinds, while the general judicial police has a right to investigate all kinds of illegal activities. The special judicial police deals with duties related to forest, maritime affairs, government monopoly, tax, military, and etc. And the range of its function is described in the “Law on the person who assumes the duty of special judicial police and the range of duty”. This special judicial police has a positive function to lessen the burden of the general judicial police by taking its share of responsibility. Investigation by the special judicial police requires a high level of capability and knowledge about jargons, work processes, and information, and thus it will be more effective to have the specialized and professional judicial police take the charge of investigation in those special fields than to have the general judicial police deal with all kinds of crimes. This paper reviewed the motive and principle of granting investigation right to the special judicial police and its range of duty, focusing on the fields of marine products, fisheries, and marine environment.
