STCW협약의 전면 개정 논의에 관한 고찰

The International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, 1978 was amended comprehensively in 1995. The IMO's STW Sub-committee took steps for another comprehensive review the STCW Convention and its Code from its 38th session which was expressed firstly by IMO Secretary-General, Mr. Efthimios Mitropoulos, during opening address in its 37th session. He expressed the view that since more than ten years had elapsed since its last major revision in 1995 and the time had come for a preliminary consideration to the need for, and the timing of, another comprehensive review of the Convention to ensure that it met the new challenges facing the shipping industry in the years to come. The STW Sub-Committee, after an in-depth discussion, agreed to undertake such a review of the STCW Convention and the MSC also approved it. It is expected that the review could be completed by the end of 2008 and the draft Convention as amended could be adopted by 2010 with a proposed entry into force in 2012. This study aims to introduce the key issues which have been under discussion for amendment of the STCW Convention and its Code and, after adopting the STCW Convention as amended, to provide influences on the academic circles and shipping industries and to propose the directions for implementing them in the domestic law.
