한국과 독일의 법의식의 문화적 토대

초록
독일의 법제도를 수용함에 있어서 현실과 규범의 괴리를 좁히려는 노력을 선행하지 않고 우리문화와 유리되어 있는 독일의 법제도를 그대로 수용하는 것은 정당성을 상실한 법규범을 창조하는 것이 되고, 그 결과 한국에서의 법치주의는 위기에 봉착하게 될 것이라는 것을 지적할 수 있다. 여기서 우리의 문화와 동떨어진, 법정신이나 그 이념만 공허하게 강제되는 법규정들을 다시금 우리의 입장에서 재검토할 필요성이 강하게 요구되는 것이다. 법제도는 인간행동과 감정, 의식에 뒤따르는 마지막 단계라고 할 수 있다. 어느 사회나 고정된 것은 없다. 문화도 마찬가지이다. 오랜 역사와 함께 형성된 문화는 지금도 변화하고 있다. 다른 사회의 문화가 계수되어 한 사회에 정착되는 과정은 다양하다. 그 문화의 사회적 기능이 검증되어 위로부터 아래로의 법제정에 의하여 수용되거나 또는 사회현실과 의식의 변화에 따라 점진적으로 토대를 갖추어 아래로부터의 변화에 맞추어 법제도가 형성될 수 있다. 특정 사회나 국가의 법제도가 다른 사회에 수용되기 위해서 그 사회의 문화적 특수성에 대한 연구와 그에 따른 교육이 선행되어야 하는 이유도 여기에 기인하는 것이다
Abstract
In importing the german legal system, it is like the creation of regulations that have not any legitimacy, if we do not go ahead by an effort to narrow wide gap between the reality and law, but import the german legal system that is not familiar with Korean culture. As a result, the Korean 'rule of law' will come to reach a crisis. For this reason, we must do a review of laws, which are wide apart with Korean culture and only the spirit of the law or whose ideology is forced to be empty. It may be said that the legal system is the last stage followed by a human behavior and feelings, awareness. The culture is the same, too. Culture formed with the longtime history still changes. The processes that some culture is taken and is firmly established in other society are in variety. A social function of the culture should be inspected and be taken under from the top by law establishment. The other, according to the change of social reality and the consciousness, the legal system is progressively formed from the bottom by the change. In order to import specific society's or specific nation's legal system, the reason why must be gone ahead of a study for the characteristic of the culture of the society and education by it, is caused by here,
