The Implication for a Criminal Procedure of the Dialectical Argumentation Theory of Douglas Walton

This paper is aimed at presenting fundamental elements on argument schemes of Douglas Walton and analyzes especially the method of persuasion dialog, argumentation diagramming and plausible argumentation. According to Douglas Walton, the purpose of his book, “Legal Argumentation and Evidence”, is to provide a new method for analyzing the structure of legal reasoning used in arguing a case and evaluation legal argumentation in general. Walton has especially emphasized that his new viewpoint is different from the traditional approaches of deductive and inductive logic because it examines legal argumentation contextually. In the Walton’s new model of argumentation presented here, the form of the argument, argumentation scheme is merely one factor in judging its worth. How the argument is used in a specific context of conversation is also crucially important. We believe that this method of dialectical argumentation of Douglas Walton will turn out to be of vitally important practical utility, both in theoretical development of criminal procedure and in tools for supporting real argumentation in criminal court of jury trial in Korea.
