'일반 사이버범죄' 법규의 문제점 - 프랑스와 한국의 관련 법률 비교 -

Considering the current situation of Korea that it serves as the test-bed of new technologies owing to the brilliantly developing IT infrastructure, it is not difficult to imagine that a new type of cyber-crime will occur in Korea that is hardly expected in other countries. Cyber-crime can be categorized diversely depending on the point of view. In this paper, it is classified into 'cyber-terror type crime' and 'general (common) type cyber-crime' according to the mode of classification of the Cyber Terror Response Center of the Korea National Police Agency. With an outline of cyber-crime, this paper reviewed some of the few problems which we can foresee in the cyber-crime related laws of France and Korea, and compared legal responses of the two jurisdictions. This paper expects that the preceding experience of one country becomes helpful for the other countries to apply the laws effectively. That said, the author highlights the importance of comparative studies to come up with effective and efficient measures against cyber-crime.
