바둑문화의 진흥을 위한 특별법 제정의 필요성과 입법방향

초록
바둑에 관하여는 정부당국의 지원없이 재단법인 한국기원을 중심으로 프로 바둑이 발전되어 왔는데, 최근 프로기사의 수의 급증에 따는 재정적 부담이 가중되고 있고, 프로기사의 병역문제와 세계화의 필요성이 문제가 된다. 현재까지 정부는 바둑문화진흥에 소극적 방관자적 입장을 취하고 있다. 바둑의 긍정적 기능에 비추어 바둑문화의 진흥을 위하여 법제도를 마련하는 것이 국가적인 과제이다. 현행 문화예술진흥법이나 문화산업진흥기본법에도 바둑에 관한 규율을 하고 있지 않고 있으며, 아울러 국민체육진흥법이나 스포츠산업진흥법에서도 바둑을 스포츠로 분류하고 있지 않아 법률적인 사각지대에 놓여 있다. 바둑에 관하여는 태권도와 유사하므로, 태권도진흥법의 모델을 따를 필요가 있다. 입법의 방향은 문화예술진흥법에 편입하는 방법, 스포츠법제에 편입하는 방법이 고려될 수 있으나, 바둑문화의 진흥을 위한 특별법을 제정하는 것이 바람직한 입법의 방향이다. 바둑문화의 진흥을 위한 특별법에서는 정부의 진흥계획수립의무화, 바둑문화의 세계화와 해외진출필요성, 바둑관련 공인자격증, 한국기원의 특수법인화, 정부의 지원과 국공유재산의 대부와 사용에 관한 사항을 규정할 필요가 있다. 우리나라가 프로바둑의 세계강국으로 지위를 계속유지하고 세계화의 목표를 달성하기 위하여는 바둑문화진흥을 위한 특별법을 제정할 필요가 있다는 점을 강조하고자 한다.
Abstract
In Korea, professional Baduk (Korean chess) has grown around the foundation named Korea Baduk Association without support of the government authorities. In the meantime, in parallel with a recent sharp rise of professional Baduk players, the foundation is faced with many challenges such as growth of financial difficulties, military service of professional Baduk players, globalization of Baduk, etc. Under these circumstances, the Korean government is still assuming the passive looker-on attitude in the matter of promoting the Baduk culture. In the light of the positive function of Baduk, legislation for promoting the Baduk culture is considered a national task. At present, Baduk is in a legal dead zone, as the existing Culture & Arts Promotion Act or Cultural Industry Promotion Basic Act does not have any provision for Baduk, and also the existing National Sports Promotion Act or Sports Industry Promotion Act does not classify Baduk as a sport. For promotion of the Baduk culture. it is required to refer to the legislation model of Taekwondo Promotion Act, as both of them resemble. In the course of legislation, Baduk may be included in the existing Culture & Arts Promotion Act or a sports related law. However, it is more desirable to legislate a separate special law for promoting the Baduk culture. Such a separate special law for promoting the Baduk culture needs to provide for the government authorities' obligations to set up promotion plans, necessity of globalizing and spreading abroad the Baduk culture, issuance of certified licenses for professional Baduk players, making the Korea Baduk Association into a specially legalized institute, supports of the government authorities, lease and use of government or public owned properties, etc. In conclusion, this paper strongly emphasizes that legislation of a special law for promoting the Baduk culture is absolutely required for the Republic of Korea to keep the position of world No. 1 professional Baduk country and achieve the goal of promoting the Baduk culture worldwide.
